SYNOPSIS AS INTRODUCED:
 
15 ILCS 335/5  from Ch. 124, par. 25

    Amends the Illinois Identification Card Act. Provides that if the applicant for an identification card is a person enrolled in a public or private high school in this State, then the applicant shall only be required to submit proof of enrollment and a current identification card issued by the high school. Provides that upon request by the Secretary, the high school evidenced in the proof of enrollment shall then verify and submit the applicant's required application information to the Secretary.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Section 5 as follows:
 
6    (15 ILCS 335/5)  (from Ch. 124, par. 25)
7    Sec. 5. Applications.
8    (a) Any natural person who is a resident of the State of
9Illinois may file an application for an identification card, or
10for the renewal thereof, in a manner prescribed by the
11Secretary. Each original application shall be completed by the
12applicant in full and shall set forth the legal name, residence
13address and zip code, social security number, birth date, sex
14and a brief description of the applicant. If the applicant is a
15person enrolled in a public or private high school in this
16State, then the applicant shall only be required to submit
17proof of enrollment and a current identification card issued by
18the high school. Upon request by the Secretary, the high school
19evidenced in the proof of enrollment shall then verify and
20submit the information required under this subsection (a) to
21the Secretary for purposes of the identification card
22application. The applicant shall be photographed, unless the
23Secretary of State has provided by rule for the issuance of

1identification cards without photographs and the applicant is
2deemed eligible for an identification card without a photograph
3under the terms and conditions imposed by the Secretary of
4State, and he or she shall also submit any other information as
5the Secretary may deem necessary or such documentation as the
6Secretary may require to determine the identity of the
7applicant. In addition to the residence address, the Secretary
8may allow the applicant to provide a mailing address. If the
9applicant is a judicial officer as defined in Section 1-10 of
10the Judicial Privacy Act or a peace officer, the applicant may
11elect to have his or her office or work address in lieu of the
12applicant's residence or mailing address. An applicant for an
13Illinois Person with a Disability Identification Card must also
14submit with each original or renewal application, on forms
15prescribed by the Secretary, such documentation as the
16Secretary may require, establishing that the applicant is a
17"person with a disability" as defined in Section 4A of this
18Act, and setting forth the applicant's type and class of
19disability as set forth in Section 4A of this Act. For the
20purposes of this subsection (a), "peace officer" means any
21person who by virtue of his or her office or public employment
22is vested by law with a duty to maintain public order or to
23make arrests for a violation of any penal statute of this
24State, whether that duty extends to all violations or is
25limited to specific violations.
26    (b) Beginning on or before July 1, 2015, for each original

1or renewal identification card application under this Act, the
2Secretary shall inquire as to whether the applicant is a
3veteran for purposes of issuing an identification card with a
4veteran designation under subsection (c-5) of Section 4 of this
5Act. The acceptable forms of proof shall include, but are not
6limited to, Department of Defense form DD-214. The Secretary
7shall determine by rule what other forms of proof of a person's
8status as a veteran are acceptable.
9    The Illinois Department of Veterans' Affairs shall confirm
10the status of the applicant as an honorably discharged veteran
11before the Secretary may issue the identification card.
12    For purposes of this subsection (b):
13    "Active duty" means active duty under an executive order of
14the President of the United States, an Act of the Congress of
15the United States, or an order of the Governor.
16    "Armed forces" means any of the Armed Forces of the United
17States, including a member of any reserve component or National
18Guard unit called to active duty.
19    "Veteran" means a person who has served on active duty in
20the armed forces and was discharged or separated under
21honorable conditions.
