    Amends the Illinois Lottery Law, the Illinois Horse Racing Act of 1975, the Riverboat Gambling Act, and the Video Gaming Act. Provides that payout of winnings of $600 or more must be accompanied by an IL-5754 form setting forth the name, address, and Social Security number of the winner and the amount of the payout. Effective immediately.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 20.1 as follows:
 
6    (20 ILCS 1605/20.1)  (from Ch. 120, par. 1170.1)
7    Sec. 20.1. Department account.
8    (a) The Department is authorized to pay validated prizes up
9to $25,000 from funds held by the Department in an account
10separate and apart from all public moneys of the State. Moneys
11in this account shall be administered by the Director
12exclusively for the purposes of issuing payments to prize
13winners authorized by this Section. Moneys in this account
14shall be deposited by the Department into the Public
15Treasurers' Investment Pool established under Section 17 of the
16State Treasurer Act. The Department shall submit vouchers from
17time to time as needed for reimbursement of this account from
18moneys appropriated for prizes from the State Lottery Fund.
19Investment income earned from this account shall be deposited
20monthly by the Department into the Common School Fund. The
21Department shall file quarterly fiscal reports specifying the
22activity of this account as required under Section 16 of the
23State Comptroller Act, and shall file quarterly with the

1General Assembly, the Auditor General, the Comptroller, and the
2State Treasurer a report indicating the costs associated with
3this activity.
4    (b) The Department is authorized to enter into an
5interagency agreement with the Office of the Comptroller or any
6other State agency to establish responsibilities, duties, and
7procedures for complying with the Comptroller's Offset System
8under Section 10.05 of the State Comptroller Act. All federal
9and State tax reporting and withholding requirements relating
10to prize winners under this Section shall be the responsibility
11of the Department. Prizes of $600 or more must be accompanied
12by an IL-5754 form setting forth the names, addresses, Social
13Security numbers, and prize shares of all persons entitled to a
14share of the prize. Moneys from this account may not be used to
15pay amounts to deferred prize winners. Moneys may not be
16transferred from the State Lottery Fund to this account for
17payment of prizes under this Section until procedures are
18implemented to comply with the Comptroller's Offset System and
19sufficient internal controls are in place to validate prizes.

21    Section 10. The Illinois Horse Racing Act of 1975 is
22amended by adding Section 27.3 as follows:

24    Sec. 27.3. Reporting payouts. For all pari-mutuel wagering

1conducted pursuant to this Act, payout of winning wagers and
2winnings from wagers of $600 or more must be accompanied by an
3IL-5754 form setting forth the name, address, and Social
4Security number of the winner and the amount of the payout.
 
5    Section 15. The Riverboat Gambling Act is amended by adding
6Section 13.06 as follows:
 
7    (230 ILCS 10/13.06 new)
8    Sec. 13.06. Reporting payouts. Payout of winnings of $600
9or more must be accompanied by an IL-5754 form setting forth
10the name, address, and Social Security number of the winner and
11the amount of the payout.
 
12    Section 20. The Video Gaming Act is amended by changing
13Section 20 as follows:
 
14    (230 ILCS 40/20)
15    Sec. 20. Direct dispensing of receipt tickets only. A video
16gaming terminal may not directly dispense coins, cash, tokens,
17or any other article of exchange or value except for receipt
18tickets. Tickets shall be dispensed by pressing the ticket
19dispensing button on the video gaming terminal at the end of
20one's turn or play. The ticket shall indicate the total amount
21of credits and the cash award, the time of day in a 24-hour
22format showing hours and minutes, the date, the terminal serial

1number, the sequential number of the ticket, and an encrypted
2validation number from which the validity of the prize may be
3determined. The player shall turn in this ticket to the
4appropriate person at the licensed establishment, licensed
5truck stop establishment, licensed fraternal establishment, or
6licensed veterans establishment to receive the cash award. Cash
7awards of $600 or more must be accompanied by an IL-5754 form
8setting forth the name, address, and Social Security number of
9the player and the amount of the cash award. The cost of the
10credit shall be one cent, 5 cents, 10 cents, or 25 cents, and
11the maximum wager played per hand shall not exceed $2. No cash
12award for the maximum wager on any individual hand shall exceed
13$500.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
