    Amends the Street Light District Act. Makes a technical change in a Section concerning the board of trustees of a street lighting district.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Street Light District Act is amended by
5changing Section 3 as follows:
 
6    (70 ILCS 3305/3)  (from Ch. 121, par. 357)
7    Sec. 3. A board of of trustees consisting of 3 members for
8the government and control of the affairs and business of the
9street lighting district incorporated under this Act shall be
10created in the following manner:
11    (1) If the district is located wholly within a single
12county, trustees for the district shall be appointed by the
13presiding officer of the county board with the advice and
14consent of the county board;
15    (2) If the district is located in more than one county, the
16number of trustees who are residents of a county shall be in
17proportion, as nearly as practicable, to the number of
18residents of the district who reside in that county in relation
19to the total population of the district.
20    Upon the expiration of the term of a trustee who is in
21office on the effective date of this amendatory Act of 1975,
22the successor shall be a resident of whichever county is
23entitled to such representation in order to bring about the

1proportional representation required herein, and he shall be
2appointed by the county board of that county, or in the case of
3a home rule county as defined by Article VII, Section 6 of the
4Constitution of 1970, the chief executive officer of that
5county, with the advice and consent of the county board.
6    Thereafter, each trustee shall be succeeded by a resident
7of the same county who shall be appointed by the same
8appointing authority; however, the provisions of the preceding
9paragraph shall apply to the appointment of the successor to
10each trustee who is in office at the time of the publication of
11each decennial Federal census of population.
12    Within 60 days after the creation of a street lighting
13district as provided in Section 1 hereof, the appropriate
14appointing authority shall appoint 3 trustees. The trustees
15shall hold their offices for one, 2 and 3 years from the first
16Monday of May next after their appointment and until their
17successors have been appointed and qualified. Thereafter on or
18before the second Monday in April of each year the appointing
19authority shall appoint one trustee whose term shall be for 3
20years commencing on the first Monday in May next after they are
21respectively appointed. The length of term of the first
22trustees shall be determined by lot at their first meeting.
23    The appointing authority shall require each of the trustees
24to enter into bond with security to be approved by the
25appointing authority in such sum as the appointing authority
26may determine.

1    A majority of the board of trustees shall constitute a
2quorum. No trustee or employee of the district shall be
3directly or indirectly interested financially in any contract,
4work or business or the sale of any article, the expense, price
5or consideration of which is paid by the district. The trustees
6shall provide and adopt a corporate seal for the district.
