    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the Chronic Kidney Disease Program.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-339 as follows:
 
7    (20 ILCS 2310/2310-339)
8    Sec. 2310-339. Chronic Kidney Disease Program.
9    (a) The The Department, subject to appropriation or other
10available funding, shall establish a Chronic Kidney Disease
11Awareness, Testing, Diagnosis and Treatment Program. The
12program may include, but is not limited to:
13        (1) Dissemination of information regarding the
14    incidence of chronic kidney disease, the risk factors
15    associated with chronic kidney disease, and the benefits of
16    early testing, diagnosis and treatment of chronic kidney
17    disease.
18        (2) Promotion information and counseling about
19    treatment options.
20        (3) Establishment and promotion of referral services
21    and testing programs.
22        (4) Development and dissemination, through print and
23    broadcast media, of public service announcements that

1    publicize the importance of awareness, testing, diagnosis
2    and treatment of chronic kidney disease.
3    (b) Any entity funded by the Program shall coordinate with
4other local providers of chronic kidney disease testing,
5diagnostic, follow-up, education, and advocacy services to
6avoid duplication of effort. Any entity funded by the Program
7shall comply with any applicable State and federal standards
8regarding chronic kidney disease testing.
9    (c) Administrative costs of the Department shall not exceed
1010% of the funds allocated to the Program. Indirect costs of
11the entities funded by this Program shall not exceed 12%. The
12Department shall define "indirect costs" in accordance with
13applicable State and federal law.
14    (d) Any entity funded by the Program shall collect data and
15maintain records that are determined by the Department to be
16necessary to facilitate the Department's ability to monitor and
17evaluate the effectiveness of the entities and the Program.
18Commencing with the Program's second year of operation, the
19Department shall submit an annual report to the General
20Assembly and the Governor. The report shall describe the
21activities and effectiveness of the Program and shall include,
22but is not limited to, the following types of information
23regarding those persons served by the Program: (i) the number,
24(ii) the ethnic, geographic, and age breakdown, (iii) the
25stages of progression, and (iv) the diagnostic and treatment
26status.

1    (e) The Department or any entity funded by the Program
2shall collect personal and medical information necessary to
3administer the Program from any individual applying for
4services under the Program. The information shall be
5confidential and shall not be disclosed other than for purposes
6directly connected with the administration of the Program or as
7otherwise provided by law or pursuant to prior written consent
8of the subject of the information.
9    (f) The Department or any entity funded by the Program may
10disclose the confidential information to medical personnel and
11fiscal intermediaries of the State to the extent necessary to
12administer the Program, and to other State public health
13agencies or medical researchers if the confidential
14information is necessary to carry out the duties of those
15agencies or researchers in the investigation, control, or
16surveillance of chronic kidney disease.
17    (g) The Department shall adopt rules to implement the
18Program in accordance with the Illinois Administrative
19Procedure Act.
