SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Snow Removal Service Liability Limitation Act. Provides that any provision in a snow plow and de-icing services contract that purports to indemnify or hold harmless a promisee from or against liability for loss or damage resulting from the negligence or omissions of the promisee is against the public policy of this State and is void and unenforceable. Effective immediately.

1    AN ACT concerning concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Snow
5Removal Service Liability Limitation Act.
 
6    Section 5. Definitions. In this Act:
7    "Promisee" means the promisee and any agents, employees,
8servants, or independent contractors who are directly
9responsible to the promisee.
10    "Snow plow and de-icing services contract" means a contract
11or understanding covering:
12        (1) plowing, shoveling, or other removal of snow or
13    other mixed precipitation from a surface;
14        (2) de-icing services; or
15        (3) a service incidental to an activity described in
16    item (1) or (2) including, but not limited to, driving or
17    otherwise moving snow plow and de-icing equipment and
18    materials.
 
19    Section 10. Certain indemnity agreements void.
20Notwithstanding any provision of law to the contrary, a
21provision, clause, covenant, or agreement contained in,
22collateral to, or affecting any snow plow and de-icing services

1contract that purports to indemnify, defend, or hold harmless,
2or has the effect of indemnifying, defending, or holding
3harmless, the promisee from or against any liability for loss
4or damage resulting from the negligence or omissions of the
5promisee is against the public policy of this State and is void
6and unenforceable.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
