1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Governmental Ethics Act is amended
5by adding Section 3A-45 as follows:
 
6    (5 ILCS 420/3A-45 new)
7    Sec. 3A-45. Late term executive appointees.
8    (a) As used in this Section, "late term executive
9appointee" means a person who is appointed, contracted with, or
10employed as a director, executive director, or other similar
11executive management position by any public body 90 or fewer
12days before the end of the then-serving Governor's term, when
13the then-serving Governor does not succeed himself or herself
14as Governor. For purposes of this Section only, "public body"
15means a board, commission, authority, task force, or other
16similar group authorized or created by State law where the
17Governor appoints one or more members of the board, commission,
18authority, task force, or other similar body.
19    (b) A late term executive appointee shall serve no longer
20than the 60th day of the term of office of the succeeding
21Governor. A late term executive appointee may be retained by
22appointment, contract, or employment after the 60th day only if
23the public body takes official action at an open meeting of

1that public body which occurs after the succeeding Governor has
2taken office.
 
3    Section 90. The State Mandates Act is amended by adding
4Section 8.39 as follows:
 
5    (30 ILCS 805/8.39 new)
6    Sec. 8.39. Exempt mandate. Notwithstanding Sections 6 and 8
7of this Act, no reimbursement by the State is required for the
8implementation of any mandate created by this amendatory Act of
9the 99th General Assembly.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
