1    AN ACT concerning the environment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 14.7 as follows:
 
6    (415 ILCS 5/14.7 new)
7    Sec. 14.7. Preservation of community water supplies.
8    (a) The Agency shall adopt rules governing all corrosion
9prevention projects carried out on community water supplies.
10Those rules shall include:
11        (1) standards for ensuring that community water
12    supplies carry out corrosion prevention and mitigation
13    methods according to corrosion prevention industry
14    standards adopted by the Agency;
15        (2) requirements that community water supplies use
16    industry trained and certified:
17            (A) protective coatings personnel to carry out
18        corrosion prevention and mitigation methods on any
19        type of substrate or surface, including, but not
20        limited to, concrete and steel; and
21            (B) inspectors to ensure that best practices and
22        standards are adhered to on each corrosion prevention
23        project; and

1        (3) standards to prevent environmental degradation
2    that might occur as a result of carrying out corrosion
3    prevention and mitigation methods, including, but not
4    limited to, standards to prevent the improper handling and
5    containment of hazardous materials, especially lead paint,
6    removed from the interior or exterior of a community water
7    supply;
8    In adopting rules under this subsection (a), the Agency
9shall obtain input from corrosion industry experts
10specializing in the training and certification of personnel to
11carry out corrosion prevention and mitigation methods.
12    (b) As used in this Section:
13    "Community water supply" has the meaning ascribed to that
14term in Section 3.145 of this Act.
15    "Corrosion" means a naturally occurring phenomenon
16commonly defined as the deterioration of a material (usually a
17metal) that results from a chemical or electrochemical reaction
18with its environment.
19    "Corrosion prevention and mitigation methods" mean:
20        (1) the preparation, application, installation,
21    removal, or general maintenance as necessary of a
22    protective coating system, including any or more of the
23    following:
24            (A) surface preparation and coating application on
25        the exterior or interior of a community water supply;
26            (B) removal of a lead-based or other hazardous

1        coating from a community water supply;
2            (C) shop painting of structural steel fabricated
3        for installation as part of a community water supply;
4        or
5            (D) installation of any polymer coating or
6        surfacing on any concrete, or other cementitious
7        substrate, that is a part of a community water supply;
8        and
9        (2) any other activities that are (i) related to
10    corrosion prevention, such as cathodic protection, of a
11    community water supply and (ii) determined by the Agency to
12    require industry trained and certified personnel to carry
13    out.
14    "Corrosion prevention project" means carrying out
15corrosion prevention and mitigation methods.
16    "Industry trained and certified" means having
17documentation that is recognized by the United States
18Department of Labor and that shows either:
19        (1) an individual's prior completion of, or current
20    enrollment in for at least the entire duration of a
21    corrosion prevention project on the community water
22    supply, a United States Department of Labor certified
23    apprenticeship training program that requires concurrent
24    on-the-job training and classroom instruction for an
25    individual to be considered adequately knowledgeable to
26    carry out corrosion prevention and mitigation methods; or

1        (2) an individual's receipt from a corrosion
2    prevention industry credentialing organization, whose
3    standards for corrosion prevention and mitigation methods
4    are recognized by the Agency, of confirmation that the
5    individual is adequately trained to carry out corrosion
6    prevention and mitigation methods or inspections.
 
7    Section 10. The Illinois Highway Code is amended by adding
8Section 4-106 as follows:
 
9    (605 ILCS 5/4-106 new)
10    Sec. 4-106. Preservation of bridge infrastructure.
11    (a) The Department shall adopt rules governing all
12corrosion prevention projects carried out on eligible bridges.
13The rules shall include:
14        (1) a process for ensuring that corrosion prevention
15    and mitigation methods are carried out according to
16    corrosion prevention industry standards adopted by the
17    Department for eligible bridges that include the use of
18    industry trained and certified:
19            (A) protective coatings personnel to carry out
20        corrosion prevention and mitigation methods on any
21        type of substrate or surface, but especially concrete
22        and steel; and
23            (B) inspectors to ensure best practices and
24        standards are adhered to on a corrosion prevention

1        project;
2        (2) a plan to prevent environmental degradation that
3    could occur as a result of carrying out corrosion
4    prevention and mitigation methods including the careful
5    handling and containment of hazardous materials,
6    especially lead paint; and
7        (3) consulting and interacting directly with, for the
8    purpose of approving industry trained and certified
9    personnel, corrosion industry experts specializing in the
10    training and certification of personnel to carry out
11    corrosion prevention and mitigation methods.
12    (b) In this Section:
13    "Corrosion" means a naturally occurring phenomenon
14commonly defined as the deterioration of a material (usually a
15metal) that results from a chemical or electrochemical reaction
16with its environment.
17    "Corrosion prevention and mitigation methods" mean:
18        (1) the preparation, application, installation,
19    removal, or general maintenance as necessary of a
20    protective coating system including the following:
21            (A) surface preparation and coating application on
22        an eligible bridge;
23            (B) removal of a lead-based or other hazardous
24        coating from an eligible bridge;
25            (C) shop painting of structural steel fabricated
26        for installation as part of an eligible bridge; and

1        (2) any other activities related to corrosion
2    prevention, such as cathodic protection, on eligible
3    bridges determined by the Department that require industry
4    trained and certified personnel to carry out.
5    "Corrosion prevention project" means carrying out
6corrosion prevention and mitigation methods during
7construction, alteration, maintenance, repair work, or at any
8other time necessary on an eligible bridge.
9    "Eligible bridge" means a bridge or overpass the
10construction, alteration, maintenance, or repair work on which
11is funded, directly or indirectly, by a municipality, a
12public-private partnership, the State, the federal government,
13or some combination thereof.
14    "Industry trained and certified" means documentation, as
15recognized by the United States Department of Labor, showing
16either:
17        (1) an individual's prior completion of, or current
18    enrollment in for at least the entire duration of a
19    corrosion prevention project on an eligible bridge, a
20    United States Department of Labor certified apprenticeship
21    training program that requires concurrent on-the-job
22    training and classroom instruction for an individual to be
23    considered adequately knowledgeable to carry out corrosion
24    prevention and mitigation methods; or
25        (2) an individual's receipt from a corrosion
