SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.25

    Amends the Medical Assistance Article of the Illinois Public Aid Code. In a provision concerning access to psychiatric mental health services, provides that the Department of Healthcare and Family Services shall reimburse qualified mental health professionals as defined by the Department and federally qualified health centers as defined in the federal Social Security Act for mental health services provided by qualified mental health professionals, as authorized by Illinois law, to recipients under the age of 21 via telepsychiatry.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-5.25 as follows:
 
6    (305 ILCS 5/5-5.25)
7    Sec. 5-5.25. Access to psychiatric mental health services.
8The General Assembly finds that providing access to psychiatric
9mental health services in a timely manner will improve the
10quality of life for persons suffering from mental illness and
11will contain health care costs by avoiding the need for more
12costly inpatient hospitalization. The Department of Healthcare
13and Family Services shall reimburse psychiatrists and
14federally qualified health centers as defined in Section
151905(l)(2)(B) of the federal Social Security Act for mental
16health services provided by psychiatrists, as authorized by
17Illinois law, to recipients via telepsychiatry. The Department
18of Healthcare and Family Services shall reimburse qualified
19mental health professionals as defined by the Department and
20federally qualified health centers as defined in Section
211905(l)(2)(B) of the federal Social Security Act for mental
22health services provided by qualified mental health
23professionals, as authorized by Illinois law, to recipients

1under the age of 21 via telepsychiatry. The Department, by
2rule, shall establish (i) criteria for such services to be
3reimbursed, including appropriate facilities and equipment to
4be used at both sites and requirements for a physician or other
5licensed health care professional to be present at the site
6where the patient is located, and (ii) a method to reimburse
7providers for mental health services provided by
8telepsychiatry.
9    On and after July 1, 2012, the Department shall reduce any
10rate of reimbursement for services or other payments or alter
11any methodologies authorized by this Code to reduce any rate of
12reimbursement for services or other payments in accordance with
13Section 5-5e.
