Amends the Hospital Licensing Act and the University of Illinois Hospital Act. Provides that if a hospital, including the University of Illinois Hospital, makes electronic personal health records available to its patients, then the hospital shall provide information about the availability of those electronic personal health records to every patient prior to the patient's discharge and shall conspicuously post information about the availability of those electronic personal health records. Effective immediately.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The University of Illinois Hospital Act is amended by adding Section 10 as follows:

(110 ILCS 330/10 new)

Sec. 10. Electronic personal health records. If the University of Illinois Hospital makes electronic personal health records available to its patients, then the University of Illinois Hospital shall conspicuously post, in an area of its offices accessible to patients, information about the availability of electronic personal health records and shall provide information, in writing, about the availability of those electronic personal health records to every patient prior to the patient's discharge.

Section 10. The Hospital Licensing Act is amended by changing Section 6.14c and by adding Section 6.14g as follows:

Sec. 6.14c. Posting of information. Every hospital shall conspicuously post for display in an area of its offices accessible to patients, employees, and visitors the following:

(1) its current license;

(2) a description, provided by the Department, of complaint procedures established under this Act and the name, address, and telephone number of a person authorized by the Department to receive complaints;

(3) a list of any orders pertaining to the hospital issued by the Department during the past year and any court orders reviewing such Department orders issued during the past year; and

(4) a list of the material available for public inspection under Section 6.14d; and .

(5) information about the availability of electronic personal health records if a hospital has made electronic personal health records available to its patients.

Sec. 6.14g. Electronic personal health records. Any hospital that has made electronic personal health records available to its patients shall provide information, in writing, about the availability of those electronic personal health records to every patient prior to the patient's discharge.

Section 99. Effective date. This Act takes effect upon becoming law.
