SYNOPSIS AS INTRODUCED:

745 ILCS 10/2-105.5 new

Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for damages to property caused by climate-related events, flooding, or the design, construction, or improvement of infrastructure intended to mitigate climate-related events or flooding.

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Local Governmental and Governmental Employees Tort Immunity Act is amended by adding Section 2-105.5 as follows:

(745 ILCS 10/2-105.5 new)

Sec. 2-105.5. Flooding. A local public entity is not liable for damages to property caused by climate-related events, flooding, or the design, construction, or improvement of infrastructure intended to mitigate climate-related events or flooding.
