SYNOPSIS AS INTRODUCED:
 
20 ILCS 862/34

    Amends the Recreational Trails of Illinois Act. Provides that the operator of an off-highway vehicle shall not be required to display an Off-Highway Vehicle Usage Stamp if the off-highway vehicle is operated on any private land with the permission of the land owner. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Recreational Trails of Illinois Act is
5amended by changing Section 34 as follows:
 
6    (20 ILCS 862/34)
7    Sec. 34. Exception from display of Off-Highway Vehicle
8Usage Stamps. The operator of an off-highway vehicle shall not
9be required to display an Off-Highway Vehicle Usage Stamp if
10the off-highway vehicle is:
11        (1) owned and used by the United States, the State of
12    Illinois, another state, or a political subdivision
13    thereof, but these off-highway vehicles shall prominently
14    display the name of the owner on the off-highway vehicle;
15        (2) operated on lands where the owner permanently
16    resides; this exception shall not apply to clubs,
17    associations, lands leased for hunting or recreational
18    purposes, or to off-highway vehicles being used by
19    outfitters as defined in the Wildlife Code as part of their
20    outfitting business;
21        (2.5) operated on any private land with the permission
22    of the land owner;
23        (3) used only on international or national competition

1    circuits in events for which written permission has been
2    obtained by the sponsoring or sanctioning body from the
3    governmental unit having jurisdiction over the location of
4    any event held in this State;
5        (4) while being used for activities associated with
6    farming or livestock production operations; or
7        (5) while being used on an off-highway vehicle grant
8    assisted site and the off-highway vehicle displays a
9    Off-Highway Vehicle Access decal.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
