SYNOPSIS AS INTRODUCED:
 
430 ILCS 15/8 new

    Amends the Gasoline Storage Act. Authorizes the State Fire Marshal, in the name of the People of the State of Illinois and through the Attorney General, the State's Attorney of any county, any interested resident of the State, or any interested legal entity within the State, to petition a court with appropriate jurisdiction for an order enjoining any person, firm, association, corporation, or other entity from any violation of the Act or the rules and regulations of the State Fire Marshal promulgated under the Act.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gasoline Storage Act is amended by adding
5Section 8 as follows:
 
6    (430 ILCS 15/8 new)
7    Sec. 8. Injunctive relief. The State Fire Marshal, in the
8name of the People of the State of Illinois and through the
9Attorney General, the State's Attorney of any county, any
10interested resident of the State, or any interested legal
11entity within the State, may petition a court with appropriate
12jurisdiction for an order enjoining any person, firm,
13association, corporation, or other entity from any violation of
14this Act or the rules and regulations of the State Fire Marshal
15promulgated under this Act. The court may enter a temporary
16restraining order without notice or bond to enjoin any conduct
17in violation of this Act or its rules.
18    If it is established that any person or entity remains in
19violation of this Act or its rules, the court may enter an
20order permanently enjoining that person or entity from any
21conduct in violation of this Act or rules adopted under this
22Act. In the case of a violation of any injunctive order entered
23under the provisions of this Section, the court may summarily

1try and punish the offender for contempt of court. The
2injunctive relief provided under this Section shall be in
3addition to any other penalty or remedy provided in this Act.
