SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/2-3020 new
55 ILCS 5/2-4015 new
55 ILCS 5/2-6002.5 new

    Amends the Counties Code. Provides that a person is not eligible to serve as a county board member if that person has been convicted of a felony under the laws of this State or comparable laws of any other state or the United States or is in arrears in the payment of a tax or other indebtedness due to a county. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Sections
52-3020, 2-4015, and 2-6002.5 as follows:
 
6    (55 ILCS 5/2-3020 new)
7    Sec. 2-3020. Eligibility requirements for county board
8members. A person is not eligible to serve as a county board
9member if that person has been convicted of a felony under the
10laws of this State or comparable laws of any other state or the
11United States or is in arrears in the payment of a tax or other
12indebtedness due to a county.
13    A home rule unit may not adopt eligibility requirements
14that are less restrictive than this Section. This Section is a
15limitation under subsection (i) of Section 6 of Article VII of
16the Illinois Constitution on the concurrent exercise by home
17rule units of the powers and functions exercised by the State.

19    Sec. 2-4015. Eligibility requirements for county board
20members. A person is not eligible to serve as a county board
21member if that person has been convicted of a felony under the
22laws of this State or comparable laws of any other state or the

9    Sec. 2-6002.5. Eligibility requirements for commissioners.
10A person is not eligible to serve as a commissioner if that
11person has been convicted of a felony under the laws of this
12State or comparable laws of any other state or the United
13States or is in arrears in the payment of a tax or other
14indebtedness due to a county.
15    A home rule unit may not adopt eligibility requirements
16that are less restrictive than this Section. This Section is a
17limitation under subsection (i) of Section 6 of Article VII of
18the Illinois Constitution on the concurrent exercise by home
19rule units of the powers and functions exercised by the State.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
