SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/5-40
10 ILCS 5/9-27.5

    Amends the State Officials and Employees Ethics Act and the Election Code. Prohibits State executive branch constitutional officers and candidates, General Assembly members and candidates, legislative political caucuses, and political committees on behalf of any of those persons or caucuses from holding political fundraising functions (now, fundraising functions in Sangamon County) during certain periods when the General Assembly is in session.

1     AN ACT concerning ethics.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Officials and Employees Ethics Act is
5 amended by changing Section 5-40 as follows:
 
6     (5 ILCS 430/5-40)
7     Sec. 5-40. Fundraising in Sangamon County. Any Except as
8 provided in this Section, any executive branch constitutional
9 officer, any candidate for an executive branch constitutional
10 office, any member of the General Assembly, any candidate for
11 the General Assembly, any political caucus of the General
12 Assembly, or any political committee on behalf of any of the
13 foregoing may not hold a political fundraising function in
14 Sangamon County on any day the legislature is in session (i)
15 during the period beginning February 1 and ending on the later
16 of the actual adjournment dates of either house of the spring
17 session and (ii) during fall veto session. For purposes of this
18 Section, the legislature is not considered to be in session on
19 a day that is solely a perfunctory session day or on a day when
20 only a committee is meeting.
21     During the period beginning June 1 and ending on the first
22 day of fall veto session each year, this Section does not apply
23 to (i) a member of the General Assembly whose legislative or

1 representative district is entirely within Sangamon County or
2 (ii) a candidate for the General Assembly from that legislative
3 or representative district.

5     Section 10. The Election Code is amended by changing
6 Section 9-27.5 as follows:
 
7     (10 ILCS 5/9-27.5)
8     Sec. 9-27.5. Fundraising in Sangamon County. In addition to
9 any other provision of this Code, fundraising events in
10 Sangamon County by certain executive branch officers and
11 candidates, legislative branch members and candidates,
12 political caucuses, and political committees are subject to the
13 State Officials and Employees Ethics Act. If a political
14 committee receives and retains a contribution that is in
15 violation of Section 5-40 of the State Officials and Employees
16 Ethics Act, then the State Board may impose a civil penalty
17 upon that political committee in an amount equal to 100% of
18 that contribution.
