1     AN ACT concerning courts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Clerks of Courts Act is amended by adding
5 Section 27.3e as follows:
 
6     (705 ILCS 105/27.3e new)
7     Sec. 27.3e. Electronic citation fee. As used in this
8 Section, "electronic citation" means the process of
9 transmitting traffic, misdemeanor, municipal ordinance,
10 conservation, or other citations and law enforcement data via
11 electronic means to a circuit court clerk.
12     To defray the expense of establishing and maintaining
13 electronic citations, each Circuit Court Clerk shall charge and
14 collect an electronic citation fee of $5. Such fee shall be
15 paid by the defendant in any traffic, misdemeanor, municipal
16 ordinance, or conservation case upon a judgment of guilty or
17 grant of supervision. This fee shall be in addition to all
18 other fees and charges and assessable as costs and shall not be
19 subject to disbursement under Section 27.5 or 27.6 of this Act.
20 60% of the fee shall be deposited into the Circuit Court Clerk
21 Electronic Citation Fund and 40% of the fee shall be disbursed
22 to the arresting agency to defray expenses related to the
23 establishment and maintenance of electronic citations. The

1 Circuit Court Clerk shall be the custodian, ex officio, of the
2 Circuit Court Clerk Electronic Citation Fund and shall use the
3 Fund to perform the duties required by the office for
4 establishing and maintaining electronic citations. The Fund
5 shall be audited by the County's auditor. The Circuit Court
6 Clerk shall not charge and collect an electronic citation fee
7 if the County Board has by ordinance elected not to be subject
8 to this Section. Any funds collected under this Section before
9 such an ordinance takes effect shall be disbursed to the
10 Illinois State Police for expenses related to the establishment
11 and maintenance of electronic citations.
