SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1404   from Ch. 95 1/2, par. 11-1404

    Amends the Illinois Vehicle Code to require every operator and passenger under the age of 18 on a motorcycle, motor driven cycle, or motorized pedalcycle to wear a helmet that meets federal safety standards and is properly fastened under the person's chin with a chin strap. Effective January 1, 2011.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 11-1404 as follows:
 
6     (625 ILCS 5/11-1404)  (from Ch. 95 1/2, par. 11-1404)
7     Sec. 11-1404. Special equipment for persons riding
8 motorcycles, motor driven cycles, or mopeds.
9     (a) The operator of a motorcycle, motor driven cycle, or
10 moped and every passenger thereon shall be protected by
11 glasses, goggles, or a transparent shield.
12     (a-5) Any operator under the age of 18 and any passenger
13 under the age of 18 of a motorcycle, motor driven cycle, or
14 motorized pedalcycle must also must wear a helmet, which meets
15 the requirements of Federal Motor Vehicle Safety Standard No.
16 218 and is properly fastened under the person's chin with a
17 chin strap.
18     (b) For the purposes of this Section, glasses, goggles, and
19 transparent shields are defined as follows:
20     "Glasses" means ordinary eye pieces such as spectacles or
21 sunglasses worn before the eye, made of shatter-resistant
22 material. Shatter-resistant material, as used in this Section,
23 means material so manufactured, fabricated, or created that it

1 substantially prevents shattering or flying when struck or
2 broken.
3     "Goggles" means a device worn before the eyes, the
4 predominant function of which is protecting the eyes without
5 obstructing peripheral vision. Goggles shall provide
6 protection from the front and sides, and may or may not form a
7 complete seal with the face.
8     "Transparent shield" means a windshield attached to the
9 front of a motorcycle that extends above the eyes when an
10 operator is seated in the normal, upright riding position, made
11 of shatter-resistant material, or a shatter-resistant
12 protective face shield that covers the wearer's eyes and face
13 at least to a point approximately to the tip of the nose.
14     (c) Contact lenses are not acceptable eye protection
15 devices.

17     Section 99. Effective date. This Act takes effect January
18 1, 2011.
