SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-4.01   from Ch. 122, par. 14-4.01

    Amends the Children with Disabilities Article of the School Code. In a Section requiring school districts to establish and maintain such special educational facilities as may be needed for children with disabilities, allows a school district to contract for administrative services or alternative facilities in order to comply with the requirements of the Article. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 14-4.01 as follows:
 
6     (105 ILCS 5/14-4.01)  (from Ch. 122, par. 14-4.01)
7     Sec. 14-4.01. Special educational facilities for children
8 with disabilities. School boards of any school districts that
9 maintain a recognized school, whether operating under the
10 general law or under a special charter, subject to any
11 limitations hereinafter specified, shall establish and
12 maintain such special educational facilities as may be needed
13 for children with disabilities as defined in Section 14-1.02 of
14 this Article who are residents of their school district, and
15 such children, residents of other school districts as may be
16 authorized by this Article. A school district may contract for
17 administrative services or alternative facilities in order to
18 comply with the requirements of this Article.
19     All such school boards shall place or by regulation may
20 authorize the director of special education to place, pursuant
21 to procedures required by this Act and rules and regulations
22 promulgated by the State Board of Education, eligible children
23 into special education programs designed to benefit children

1 with disabilities defined in Sections 14-1.02 through 14-1.07
2 of this Act.
3     All school districts, administrative districts or
4 governing boards responsible for providing special education
5 services shall submit to the appropriate regional
6 superintendent comprehensive plans or modifications thereto
7 for the provision of special education services in accordance
8 with rules promulgated by the State Board of Education. Copies
9 of comprehensive plans or modifications thereto shall be
10 forwarded by the regional superintendent to the State Board of
11 Education. Regional superintendents who provide special
12 education services shall submit comprehensive plans or
13 modifications thereto directly to the State Board of Education.
14 Comprehensive plans or modifications thereto shall be made
15 available by regional superintendents for public inspection
16 during regular business hours.
17     The State Board of Education shall provide for the
18 submission of comprehensive plans not more frequently than once
19 every 3 years but may require the submission of such
20 modifications as it deems necessary to achieve the purposes of
21 this Act and applicable federal law.

23     Section 99. Effective date. This Act takes effect upon
24 becoming law.
