SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/7-3-9 new

    Amends the Illinois Municipal Code. Provides that the owner or owners of record of land may disconnect from a municipality, if (i) the land is located within a county with a population of less than 10,000, (ii) the land contains 10 or more contiguous acres not entirely encompassed by the municipality, and (iii) the land was annexed by the municipality not more than 5 years prior to the effective date of the amendatory Act. Sets forth the procedure for disconnection. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by adding
5 Section 7-3-9 as follows:
 
6     (65 ILCS 5/7-3-9 new)
7     Sec. 7-3-9. Disconnection under certain circumstances. In
8 a county with a population of less than 10,000, an owner or
9 owners of record of 10 or more contiguous acres of land not
10 entirely encompassed by a municipality on the date of this
11 amendatory Act of the 96th General Assembly, whose land was
12 annexed by the municipality not more than 5 years prior to the
13 effective date of this amendatory Act of the 96th General
14 Assembly, may disconnect from the municipality. The owner or
15 owners of record must file a written letter with the
16 municipality requesting to be disconnected from the
17 municipality. The corporate authorities of the municipality
18 must read the letter at the next scheduled meeting after the
19 letter is filed. After reading the letter at the meeting, the
20 corporate authorities must permit the disconnection if the
21 requirements of this Section are met.
