SYNOPSIS AS INTRODUCED:

65 ILCS 5/7-3-9 new

Amends the Illinois Municipal Code. Provides that the owner or owners of record of land may disconnect from a municipality, if (i) the land is located within a county with a population of less than 10,000, (ii) the land contains 10 or more contiguous acres not entirely encompassed by the municipality, and (iii) the land was annexed by the municipality not more than 5 years prior to the effective date of the amendatory Act. Sets forth the procedure for disconnection. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 7-3-9 as follows:

Sec. 7-3-9. Disconnection under certain circumstances. In a county with a population of less than 10,000, an owner or owners of record of 10 or more contiguous acres of land not entirely encompassed by a municipality on the date of this amendatory Act of the 96th General Assembly, whose land was annexed by the municipality not more than 5 years prior to the effective date of this amendatory Act of the 96th General Assembly, may disconnect from the municipality. The owner or owners of record must file a written letter with the municipality requesting to be disconnected from the municipality. The corporate authorities of the municipality must read the letter at the next scheduled meeting after the letter is filed. After reading the letter at the meeting, the corporate authorities must permit the disconnection if the requirements of this Section are met.

Section 99. Effective date. This Act takes effect upon becoming law.
