1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Street Light District Act is amended by
5 changing Section 2c as follows:
 
6     (70 ILCS 3305/2c)  (from Ch. 121, par. 356c)
7     Sec. 2c. Disconnection. Any territory within a street
8 lighting district that is or has been annexed to a city,
9 village or incorporated town that provides street lighting
10 within such city, village or incorporated town is, by operation
11 of law, disconnected from the street lighting district as of
12 the January first after such territory is annexed to the city,
13 village or incorporated town, or in case territory has been so
14 annexed prior to the effective date of this amendatory Act of
15 1959, as of January 1, 1960. If there are any bonds of the
16 street lighting district outstanding and unpaid at the time
17 such territory is annexed to the city, village or incorporated
18 town, such territory shall remain liable for its proportionate
19 share of such bonded indebtedness and the street lighting
20 district may continue to levy and extend taxes upon the taxable
21 property in such territory for the purpose of amortizing such
22 bonds until such time as such bonds are retired.
23     Territory shall not be disconnected from a street lighting

1 district if all of the following criteria are met: (i) the
2 municipality which contains all or part of the street lighting
3 district does not levy a property tax on the taxable property
4 in the territory, (ii) the municipality passes an ordinance
5 permitting the street lighting district to operate and levy a
6 tax, and (iii) the municipality does not collect a franchise
7 fee from an electrical utility.

9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
