SYNOPSIS AS INTRODUCED:

Amends the Illinois Vehicle Code and the State Finance Act. Creates the Healthy Trees, Happy Homes Fund as a special fund in the State treasury. Provides for the issuance of Healthy Trees, Happy Homes license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $40 at original issuance and $27 at renewal. Provides that $25 of the additional original issuance fee and the renewal fee shall be deposited into the Healthy Trees, Happy Homes Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, the moneys in the Healthy Trees, Happy Homes Fund shall be paid to the Illinois Arborist Association for the purpose of training professional arborists in the latest advancements in the tree care industry, educating homeowners and children about the importance of tree care, and tree planting programs.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 5.719 as follows:

Sec. 5.719. The Healthy Trees, Happy Homes Fund.

Section 10. The Illinois Vehicle Code is amended by adding Section 3-684 as follows:

Sec. 3-684. Healthy Trees, Happy Homes license plate.

(a) The Secretary, upon receipt of all applicable fees and applications made in the form prescribed by the Secretary, may issue special registration plates designated as Healthy Trees, Happy Homes license plates. The special plates issued under this Section shall be affixed only to passenger vehicles of the first division, motor vehicles of the second division weighing not more than 8,000 pounds, recreational vehicles as defined by Section 1-169 of this Code, and boat trailers with a gross trailer weight rating of 10,000 or less pounds. Plates issued under this Section shall expire according to the multi-year procedure established by Section 3-414.1 of this Code.

(b) The design and color of the plates shall be developed by Healthy Trees, Happy Homes and shall be subject to the approval of the Secretary of State. Appropriate documentation, as determined by the Secretary, shall accompany the application. The Secretary, in his or her discretion, may allow the plates to be issued as vanity or personalized plates under Section 3-405.1 of this Code. The Secretary shall prescribe stickers or decals as provided under Section 3-412 of this Code.

(c) An applicant for the special plate shall be charged a $40 fee for original issuance in addition to the appropriate registration fee. Of this fee, $25 shall be deposited into the Healthy Trees, Happy Homes Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund, to be used by the Secretary to help defray the administrative processing costs.

For each registration renewal period, a $27 fee, in addition to the appropriate registration fee, shall be charged. Of this fee, $25 shall be deposited into the Healthy Trees, Happy Homes Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund.

(d) The Healthy Trees, Happy Homes Fund is created as a special fund in the State treasury. All money in the Healthy Trees, Happy Homes Fund shall be paid, subject to appropriation by the General Assembly and approval by the Secretary of State, as grants to the Illinois Arborist Association for the purpose of training professional arborists in the latest advancements in the tree care industry, educating homeowners and children about the importance of tree care, and tree planting programs.
