1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-414, 3-415, and 3-806 and by adding Sections 3-684
6 and 3-806.7 as follows:
 
7     (625 ILCS 5/3-414)  (from Ch. 95 1/2, par. 3-414)
8     Sec. 3-414. Expiration of registration.
9     (a) Every vehicle registration under this Chapter and every
10 registration card and registration plate or registration
11 sticker issued hereunder to a vehicle shall be for the periods
12 specified in this Chapter and shall expire at midnight on the
13 day and date specified in this Section as follows:
14         1. When registered on a calendar year basis commencing
15     January 1, expiration shall be on the 31st day of December
16     or at such other date as may be selected in the discretion
17     of the Secretary of State; however, through December 31,
18     2004, registrations of apportionable vehicles,
19     motorcycles, motor driven cycles and pedalcycles shall
20     commence on the first day of April and shall expire March
21     31st of the following calendar year;
22         1.1. Beginning January 1, 2005, registrations of
23     motorcycles and motor driven cycles shall commence on

1     January 1 and shall expire on December 31 or on another
2     date that may be selected by the Secretary; registrations
3     of apportionable vehicles and pedalcycles, however, shall
4     commence on the first day of April and shall expire March
5     31 of the following calendar year;
6         2. When registered on a 2 calendar year basis
7     commencing January 1 of an even-numbered year, expiration
8     shall be on the 31st day of December of the ensuing
9     odd-numbered year, or at such other later date as may be
10     selected in the discretion of the Secretary of State not
11     beyond March 1 next;
12         3. When registered on a fiscal year basis commencing
13     July 1, expiration shall be on the 30th day of June or at
14     such other later date as may be selected in the discretion
15     of the Secretary of State not beyond September 1 next;
16         4. When registered on a 2 fiscal year basis commencing
17     July 1 of an even-numbered year, expiration shall be on the
18     30th day of June of the ensuing even-numbered year, or at
19     such other later date as may be selected in the discretion
20     of the Secretary of State not beyond September 1 next;
21         5. When registered on a 4 fiscal year basis commencing
22     July 1 of an even-numbered year, expiration shall be on the
23     30th day of June of the second ensuing even-numbered year,
24     or at such other later date as may be selected in the
25     discretion of the Secretary of State not beyond September 1
26     next;

1     (b) Vehicle registrations of vehicles of the first division
2 shall be for a calendar year, or 2 calendar year, or 3 calendar
3 year basis as provided for in this Chapter.
4     Vehicle registrations of vehicles under Sections 3-807,
5 3-808 and 3-809 shall be on an indefinite term basis or a 2
6 calendar year basis as provided for in this Chapter.
7     Vehicle registrations for vehicles of the second division
8 shall be for a fiscal year, 2 fiscal year or calendar year
9 basis as provided for in this Chapter.
10     Motor vehicles registered under the provisions of Section
11 Sections 3-402.1 and 3-405.3 shall be issued multi-year
12 registration plates with a new registration card issued
13 annually upon payment of the appropriate fees. Motor vehicles
14 registered under the provisions of Section 3-405.3 shall be
15 issued mutli-year registration plates with a new multi-year
16 registration card issued pursuant to subsections (j) and (k) of
17 this Section upon payment of the appropriate fees.
18 Apportionable trailers and apportionable semitrailers
19 registered under the provisions of Section 3-402.1 shall be
20 issued multi-year registration plates and cards that will be
21 subject to revocation for failure to pay annual fees required
22 by Section 3-814.1. The Secretary shall determine when these
23 vehicles shall be issued new registration plates.
24     (c) Every vehicle registration specified in Section 3-810
25 and every registration card and registration plate or
26 registration sticker issued thereunder shall expire on the 31st

1 day of December of each year or at such other date as may be
2 selected in the discretion of the Secretary of State.
3     (d) Every vehicle registration for a vehicle of the second
4 division weighing over 8,000 pounds, except as provided in
5 paragraph (g) of this Section, and every registration card and
6 registration plate or registration sticker, where applicable,
7 issued hereunder to such vehicles shall be issued for a fiscal
8 year commencing on July 1st of each registration year. However,
9 the Secretary of State may, pursuant to an agreement or
10 arrangement or declaration providing for apportionment of a
11 fleet of vehicles with other jurisdictions, provide for
12 registration of such vehicles under apportionment or for all of
13 the vehicles registered in Illinois by an applicant who
14 registers some of his vehicles under apportionment on a
15 calendar year basis instead, and the fees or taxes to be paid
16 on a calendar year basis shall be identical to those specified
17 in this Act for a fiscal year registration. Provision for
18 installment payment may also be made.
19     (e) Semitrailer registrations under apportionment may be
20 on a calendar year under a reciprocal agreement or arrangement
21 and all other semitrailer registrations shall be on fiscal year
22 or 2 fiscal year or 4 fiscal year basis as provided for in this
23 Chapter.
24     (f) The Secretary of State may convert annual registration
25 plates or 2-year registration plates, whether registered on a
26 calendar year or fiscal year basis, to multi-year plates. The

1 determination of which plate categories and when to convert to
2 multi-year plates is solely within the discretion of the
3 Secretary of State.
4     (g) After January 1, 1975, each registration, registration
5 card and registration plate or registration sticker, where
6 applicable, issued for a recreational vehicle or recreational
7 or camping trailer, except a house trailer, used exclusively by
8 the owner for recreational purposes, and not used commercially
9 nor as a truck or bus, nor for hire, shall be on a calendar year
10 basis; except that the Secretary of State shall provide for
11 registration and the issuance of registration cards and plates
12 or registration stickers, where applicable, for one 6-month
13 period in order to accomplish an orderly transition from a
14 fiscal year to a calendar year basis. Fees and taxes due under
15 this Act for a registration year shall be appropriately reduced
16 for such 6-month transitional registration period.
17     (h) The Secretary of State may, in order to accomplish an
18 orderly transition for vehicles registered under Section
19 3-402.1 of this Code from a calendar year registration to a
20 March 31st expiration, require applicants to pay fees and taxes
21 due under this Code on a 15 month registration basis. However,
22 if in the discretion of the Secretary of State this creates an
23 undue hardship on any applicant the Secretary may allow the
24 applicant to pay 3 month fees and taxes at the time of
25 registration and the additional 12 month fees and taxes to be
26 payable no later than March 31 of the year after this

1 amendatory Act of 1991 takes effect.
2     (i) The Secretary of State may stagger registrations, or
3 change the annual expiration date, as necessary for the
4 convenience of the public and the efficiency of his Office. In
5 order to appropriately and effectively accomplish any such
6 staggering, the Secretary of State is authorized to prorate all
7 required registration fees, rounded to the nearest dollar, but
8 in no event for a period longer than 18 months, at a monthly
9 rate for a 12 month registration fee.
10     (j) The Secretary of State may enter into an agreement with
11 a rental owner, as defined in Section 3-400 of this Code, who
12 registers a fleet of motor vehicles of the first division
13 pursuant to Section 3-405.3 of this Code to provide for the
14 registration of the rental owner's vehicles on a 2 or 3
15 calendar year basis and the issuance of multi-year registration
16 plates with a new registration card issued up to every 3 years.
17     (k) The Secretary of State may provide multi-year
18 registration cards for any registered fleet of motor vehicles
19 of the first or second division that are registered pursuant to
20 Section 3-405.3 of this Code. Each motor vehicle of the
21 registered fleet must carry an unique multi-year registration
22 card that displays the vehicle identification number of the
23 registered motor vehicle. The Secretary of State shall
24 promulgate rules in order to implement multi-year
25 registrations.

2     Sec. 3-415. Application for and renewal of registration.
3 (a) Calendar year. Application for renewal of a vehicle
4 registration shall be made by the owner, as to those vehicles
5 required to be registered on a calendar registration year, not
6 later than December 1 of each year, upon proper application and
7 by payment of the registration fee and tax for such vehicle, as
8 provided by law except that application for renewal of a
9 vehicle registration, as to those vehicles required to be
10 registered on a staggered calendar year basis, shall be made by
11 the owner in the form and manner prescribed by the Secretary of
12 State.
13     (b) Fiscal year. Application for renewal of a vehicle
14 registration shall be made by the owner, as to those vehicles
15 required to be registered on a fiscal registration year, not
16 later than June 1 of each year, upon proper application and by
17 payment of the registration fee and tax for such vehicle as
18 provided by law, except that application for renewal of a
19 vehicle registration, as to those vehicles required to be
20 registered on a staggered fiscal year basis, shall be made by
21 the owner in the form and manner prescribed by the Secretary of
22 State.
23     (c) Two calendar years. Application for renewal of a
24 vehicle registration shall be made by the owner, as to those
25 vehicles required to be registered for 2 calendar years, not

1 later than December 1 of the year preceding commencement of the
2 2-year registration period, except that application for
3 renewal of a vehicle registration, as to those vehicles
4 required to be registered for 2 years on a staggered
5 registration basis, shall be made by the owner in the form and
6 manner prescribed by the Secretary of State.
7     (d) Two fiscal years. Application for renewal of a vehicle
8 registration shall be made by the owner, as to those vehicles
9 required to be registered for 2 fiscal years, not later than
10 June 1 immediately preceding commencement of the 2-year
11 registration period, except that application for renewal of a
12 vehicle registration, as to those vehicles required to be
13 registered for 2 fiscal years on a staggered registration
14 basis, shall be made by the owner in the form and manner
15 prescribed by the Secretary of State.
16     (d-5) Three calendar years. Application for renewal of a
17 vehicle registration shall be made by the owner, as to those
18 vehicles required to be registered for 3 calendar years, not
19 later than December 1 of the year preceding commencement of the
20 3-year registration period.
21     (e) Time of application. The Secretary of State may receive
22 applications for renewal of registration and grant the same and
23 issue new registration cards and plates or registration
24 stickers at any time prior to expiration of registration. No
25 person shall display upon a vehicle, the new registration
26 plates or registration stickers prior to the dates the

1 Secretary of State in his discretion may select.
2     (f) Verification. The Secretary of State may further
3 require, as to vehicles for-hire, that applications be
4 accompanied by verification that fees due under the Illinois
5 Motor Carrier of Property Law, as amended, have been paid.
6     (g) Applications for registration renewal shall include
7 information relating to the insurance policy for the motor
8 vehicle, including the name of the insurer that issued the
9 policy, the policy number, and the expiration date of the
10 policy.

12     (625 ILCS 5/3-684 new)
13     Sec. 3-684. Operation Iraqi Freedom License Plates.
14     (a) In addition to any other special license plate, the
15 Secretary, upon receipt of all applicable fees and applications
16 made in the form prescribed by the Secretary of State, may
17 issue Operation Iraqi Freedom license plates to residents of
18 Illinois who meet eligibility requirements prescribed by the
19 Secretary of State. The special Operation Iraqi Freedom plate
20 issued under this Section shall be affixed only to passenger
21 vehicles of the first division, motorcycles, and motor vehicles
22 of the second division weighing not more than 8,000 pounds.
23 Plates issued under this Section shall expire according to the
24 staggered multi-year procedure established by Section 3-414.1
25 of this Code.

1     (b) The design, color, and format of the plates shall be
2 wholly within the discretion of the Secretary of State. The
3 Secretary may, in his or her discretion, allow the plates to be
4 issued as vanity plates or personalized in accordance with
5 Section 3-405.1 of this Code. The plates are not required to
6 designate "Land Of Lincoln", as prescribed in subsection (b) of
7 Section 3-412 of this Code. The Secretary shall prescribe the
8 eligibility requirements and, in his or her discretion, shall
9 approve and prescribe stickers or decals as provided under
10 Section 3-412.
11     (c) An applicant shall be charged a $15 fee for original
12 issuance in addition to the applicable registration fee. This
13 additional fee shall be deposited into the Secretary of State
14 Special License Plate Fund.

16     Sec. 3-806. Registration Fees; Motor Vehicles of the First
17 Division. Every owner of any other motor vehicle of the first
18 division, except as provided in Sections 3-804, 3-805, 3-806.3,
19 3-806.7, and 3-808, and every second division vehicle weighing
20 8,000 pounds or less, shall pay the Secretary of State an
21 annual registration fee at the following rates:

2     Beginning with the 2010 registration year a $1 surcharge
3 shall be collected in addition to the above fees for motor
4 vehicles of the first division, motorcycles, motor driven
5 cycles, and pedalcycles to be deposited into the State Police
6 Vehicle Fund.

9     Sec. 3-806.7. Registration fees for active duty military
10 personnel.
11     (a) Beginning with the 2011 registration year, the standard
12 registration fee set forth in Section 3-806 of this Code for
13 passenger motor vehicles of the first division and motor
14 vehicles of the second division weighing not more than 8,000
15 pounds and registered under Section 3-815 of this Code, shall
16 be reduced by 50% for any Illinois vehicle owner who was on
17 active duty as a member of the Armed Forces of the United
18 States and stationed outside of the United States for a period
19 of 90 days or longer during the preceding registration year.
20     (b) Illinois residents who are members of the Armed Forces
21 of the United States and who have been stationed outside of the
22 United States for a period of 6 months or longer, and who
23 placed their registered motor vehicle in storage during the
24 time they served abroad, shall be entitled to credit for the
25 unused portion of that registration when they renew the

1 registration of that vehicle upon their return to the United
2 States. For each month or part thereof that the vehicle was in
3 storage and had current registration, the member of the armed
4 forces shall receive one month of registration without charge.
