AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois is amended by adding Section 605-1005 as follows:

Sec. 605-1005. Retail Energy Efficiency Appliance Program; contingency allotment.

(a) For the purposes of this Section:

(1) "Program" means the white goods appliances (Earth Day 2010) portion of the Retail Energy Efficiency Appliance Program administered by the Department.

(2) "Department" means the Department of Commerce and Economic Opportunity.

(b) The Department, as the department responsible for administering the Program, may establish and administer a contingency allotment for the purpose of reimbursing sellers who participated in the Program for the costs of rebates paid under the Program that have not been reimbursed because the federal allocation for that purpose was insufficient. The contingency allotment shall consist of moneys appropriated to the Department for that specific purpose.

(c) The contingency allotment may be used only if the Program first expends its entire funding allotment for reimbursing sellers for the costs of rebates on sales of white goods appliances that were reported from the first day of the program, Friday, April 16, 2010, through the third sales data reporting period ending at noon on Monday, April 19, 2010.

(d) If it is determined that the contingency allotment is needed to pay program participants, the Program will terminate at 6:00 pm on Monday, April 19, 2010, and the Department shall release, by Monday, May 10, 2010, the additional funds to the Midwest Energy Efficiency Alliance for distribution to program participants. If it is determined that some or all of the contingency allotment is not needed, the remaining funds shall not be spent and any remaining funds in the possession of the Alliance shall be deposited into the General Revenue Fund.

(e) Total expenditures from the contingency allotment shall not exceed $3,400,000.

Section 99. Effective date. This Act takes effect upon becoming law.
