1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Commerce and Economic
5 Opportunity Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 605-1005 as follows:
 
7     (20 ILCS 605/605-1005 new)
8     Sec. 605-1005. Retail Energy Efficiency Appliance Program;
9 contingency allotment.
10     (a) For the purposes of this Section:
11         (1) "Program" means the white goods appliances (Earth
12     Day 2010) portion of the Retail Energy Efficiency Appliance
13     Program administered by the Department.
14         (2) "Department" means the Department of Commerce and
15     Economic Opportunity.
16     (b) The Department, as the department responsible for
17 administering the Program, may establish and administer a
18 contingency allotment for the purpose of reimbursing sellers
19 who participated in the Program for the costs of rebates paid
20 under the Program that have not been reimbursed because the
21 federal allocation for that purpose was insufficient. The
22 contingency allotment shall consist of moneys appropriated to
23 the Department for that specific purpose.

1     (c) The contingency allotment may be used only if the
2 Program first expends its entire funding allotment for
3 reimbursing sellers for the costs of rebates on sales of white
4 goods appliances that were reported from the first day of the
5 program, Friday, April 16, 2010, through the third sales data
6 reporting period ending at noon on Monday, April 19, 2010.
7     (d) If it is determined that the contingency allotment is
8 needed to pay program participants, the Program will terminate
9 at 6:00 pm on Monday, April 19, 2010, and the Department shall
10 release, by Monday, May 10, 2010, the additional funds to the
11 Midwest Energy Efficiency Alliance for distribution to program
12 participants. If it is determined that some or all of the
13 contingency allotment is not needed, the remaining funds shall
14 not be spent and any remaining funds in the possession of the
15 Alliance shall be deposited into the General Revenue Fund.
16     (e) Total expenditures from the contingency allotment
17 shall not exceed $3,400,000.
 
18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
