SYNOPSIS AS INTRODUCED:

40 ILCS 5/16-133.6 new

Amends the Downstate Teacher Article of the Illinois Pension Code. Provides that a member's annuity under the Article may not be reduced if, as the result of a contract negotiated during any of the years used to determine final average salary, the member agrees to receive an increase in salary and wages in lieu of previously nonreportable benefits. Effective immediately.

AN ACT concerning public employee benefits.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by adding Section 16-133.6 as follows:

(40 ILCS 5/16-133.6 new)

Sec. 16-133.6. Reduction in annuity prohibited. Notwithstanding any other provision of this Article or its rules to the contrary, a member's annuity under this Article may not be reduced if, as the result of a contract negotiated during any of the years used to determine final average salary, the member agrees to receive an increase in salary and wages in lieu of previously nonreportable benefits.

Section 99. Effective date. This Act takes effect upon becoming law.
