SYNOPSIS AS INTRODUCED:

Amends the State Finance Act and the Emergency Medical Services (EMS) Systems Act. Creates the Coroner Trauma Fund, a special fund in the State Treasury. Provides that the Department of Public Health shall distribute 97.5% of the moneys deposited into the Coroner Trauma Fund to Illinois coroners and medical examiners; that no money may be distributed to a coroner or medical examiner located outside of the State; and that the distribution to individual coroners and medical examiners shall be based on the total number of trauma deaths where the manner of death is certified by the coroner, medical examiner, or coroner's inquest jury to be ACCIDENT, SUICIDE, HOMICIDE, or UNDETERMINED. Contains provisions concerning payment calculations under the fund, reporting requirements for county coroners or medical examiners, and distribution dates. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 5.755 as follows:

Sec. 5.755. Coroner Trauma Fund.

Section 10. The Emergency Medical Services (EMS) Systems Act is amended by adding Section 3.225a as follows:

Sec. 3.225a. Coroner Trauma Fund.

(a) The Department shall distribute 97.5% of the moneys deposited into the Coroner Trauma Fund, a special fund in the State Treasury, to Illinois coroners and medical examiners. No money may be distributed to a coroner or medical examiner located outside of the State. The distribution to individual coroners and medical examiners shall be based on the total number of trauma deaths where the manner of death is certified by the coroner, medical examiner, or coroner's inquest jury to be ACCIDENT, SUICIDE, HOMICIDE, or UNDETERMINED. Traumatic deaths shall include all deaths listed under Section 515.2050(c)(2) of Title 77 of the Illinois Administrative Code (Trauma Center Uniform Reporting Requirements).

(b) Moneys in the fund shall be allocated proportionally to each coroner and medical examiner based on the total number of trauma deaths certified by the county coroner or medical examiner and the moneys shall be collected from fees matching all fees collected pursuant to the Trauma Center Fund as established in Section 3.225 of this Act.

(c) At the beginning of each State fiscal year, the Department shall calculate a per trauma case allocation for each coroner and medical examiner, which shall be used to determine each coroner and medical examiner's share of funds collected during the previous State fiscal year.

(d) To determine the percent of the Coroner Trauma Fund to be received by each coroner or medical examiner, the Department shall divide the total moneys deposited into the Coroner Trauma Fund, after deducting administrative fees not exceeding 2.5% of total moneys collected, by the total number of traumatic deaths in the entire State during the preceding State fiscal year.

(e) Each county coroner or medical examiner shall provide to the Department, by July 15 of each year, a report of all traumatic deaths which occurred in the prior State fiscal year. The report shall include all of the following:

(1) Decedent's full name.

(2) Decedent's date of birth.

(3) Decedent's social security number (if available).

(4) Decedent's date of death.

(5) Decedent's cause of death.

(6) Decedent's manner of death.

(f) Data collected from individual coroners and medical examiners shall be cross-referenced with death certificates registered with the Office of Vital Records to confirm accuracy.

(g) The Department shall distribute moneys from the Coroner Trauma Fund within 90 days after July 1 of each year.

Section 99. Effective date. This Act takes effect upon becoming law.
