SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2III new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that whenever a person sells to a consumer merchandise consisting of a wireless telecommunication device that is not subject to a contract for wireless telecommunication service, the seller must obtain the consumer's name and address. Requires the seller to maintain that record for one year. Makes a seller's failure to do so an unlawful practice under the Act.

1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2III as follows:
 
6     (815 ILCS 505/2III new)
7     Sec. 2III. Sale of wireless telecommunication device not
8 subject to contract for wireless telecommunication service.
9 Whenever a person sells to a consumer merchandise consisting of
10 a wireless telecommunication device that is not subject to a
11 contract for wireless telecommunication service, the seller
12 must obtain the consumer's name and address. The seller must
13 maintain that record for one year. A seller's failure to comply
14 with this Section is an unlawful practice within the meaning of
15 this Act.
