SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/3-6   from Ch. 23, par. 3-6

    Amends the Aid to the Aged, Blind, or Disabled Article of the Illinois Public Aid Code. Requires a mechanism to exist which will allow certain medical assistance recipients required to receive care administered through an entity licensed under the Health Maintenance Organization Act or a third party administrator paid through a capitated payment rate, to opt out of such coverage and enroll in a fee-for-service based coverage, if certain conditions apply. Effective July 1, 2010.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 3-6 as follows:
 
6     (305 ILCS 5/3-6)  (from Ch. 23, par. 3-6)
7     Sec. 3-6. Entitlement to medical assistance.
8     (a) Persons qualified for financial aid for basic
9 maintenance shall be entitled to receive, under Article V, all
10 necessary medical assistance.
11     (b) If any persons entitled to receive medical assistance
12 under this Section are required to receive care administered
13 through an entity licensed under the Health Maintenance
14 Organization Act or a third party administrator paid through a
15 capitated payment rate at the same time that other persons
16 covered under this Section or Article V of this Code, or the
17 Children's Health Insurance Program Act or the Covering ALL
18 KIDS Health Insurance Act are able to access care through a
19 fee-for-service based system, then a mechanism shall exist
20 which allows such persons to opt out of the capitated or HMO
21 based coverage and to enroll in a fee-for-service based
22 coverage.

1     Section 99. Effective date. This Act takes effect July 1,
2 2010.
