1     AN ACT concerning professional regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Clinical Psychologist Licensing Act is
5 amended by changing Sections 7 and 13 as follows:
 
6     (225 ILCS 15/7)  (from Ch. 111, par. 5357)
7     (Section scheduled to be repealed on January 1, 2017)
8     Sec. 7. Board. The Secretary shall appoint a Board that
9 shall serve in an advisory capacity to the Secretary.
10     The Board shall consist of 7 persons, 4 of whom are
11 licensed clinical psychologists, and actively engaged in the
12 practice of clinical psychology, 2 of whom are licensed
13 clinical psychologists and are full time faculty members of
14 accredited colleges or universities who are engaged in training
15 clinical psychologists, and one of whom is a public member who
16 is not a licensed health care provider. In appointing members
17 of the Board, the Secretary shall give due consideration to the
18 adequate representation of the various fields of health care
19 psychology such as clinical psychology, school psychology and
20 counseling psychology. In appointing members of the Board, the
21 Secretary shall give due consideration to recommendations by
22 members of the profession of clinical psychology and by the
23 State-wide organizations representing the interests of

1 clinical psychologists and organizations representing the
2 interests of academic programs as well as recommendations by
3 approved doctoral level psychology programs in the State of
4 Illinois. The members shall be appointed for a term of 4 years.
5 No member shall be eligible to serve for more than 2 full
6 terms. Any appointment to fill a vacancy shall be for the
7 unexpired portion of the term. A member appointed to fill a
8 vacancy for an unexpired term for a duration of 2 years or more
9 may be reappointed for a maximum of one term and a member
10 appointed to fill a vacancy for an unexpired term for a
11 duration of less than 2 years may be reappointed for a maximum
12 of 2 terms. The Secretary may remove any member for cause at
13 any time prior to the expiration of his or her term.
14     The Board shall annually elect one of its members as
15 chairperson and vice chairperson.
16     The members of the Board shall be reimbursed for all
17 authorized legitimate and necessary expenses incurred in
18 attending the meetings of the Board.
19     The Secretary shall give due consideration to all
20 recommendations of the Board. In the event the Secretary
21 disagrees with or takes action contrary to the recommendation
22 of the Board, he or she shall provide the Board with a written
23 and specific explanation of his or her actions.
24     The Board may make recommendations on all matters relating
25 to continuing education including the number of hours necessary
26 for license renewal, waivers for those unable to meet such

1 requirements and acceptable course content. Such
2 recommendations shall not impose an undue burden on the
3 Department or an unreasonable restriction on those seeking
4 license renewal.
5     Four A majority of the Board members currently appointed
6 shall constitute a quorum. A quorum is required for all Board
7 decisions. A vacancy in the membership of the Board shall not
8 impair the right of a quorum to perform all of the duties of
9 the Board.
10     Members of the Board shall have no liability in any action
11 based upon any disciplinary proceeding or other activity
12 performed in good faith as a member of the Board.
13     The Secretary may terminate the appointment of any member
14 for cause which in the opinion of the Secretary reasonably
15 justifies such termination.

19     Sec. 13. License renewal; restoration. The expiration date
20 and renewal period for each license issued under this Act shall
21 be set by rule. Every holder of a license under this Act may
22 renew such license during the 90-day period immediately
23 preceding the expiration date thereof upon payment of the
24 required renewal fees and demonstrating compliance with any
25 continuing education requirements. The Department shall adopt

1 rules establishing minimum requirements of continuing
2 education and means for verification of the completion of the
3 continuing education requirements. The Department may, by
4 rule, specify circumstances under which the continuing
5 education requirements may be waived.
6     A clinical psychologist who has permitted his or her
7 license to expire or who has had his or her license on inactive
8 status may have his or her license restored by making
9 application to the Department and filing proof acceptable to
10 the Department, as defined by rule, of his or her fitness to
11 have his or her license restored, including evidence certifying
12 to active practice in another jurisdiction satisfactory to the
13 Department and by paying the required restoration fee.
14     If the clinical psychologist has not maintained an active
15 practice in another jurisdiction satisfactory to the
16 Department, the Board shall determine, by an evaluation program
17 established by rule, his or her fitness to resume active status
18 and may require the clinical psychologist to complete a period
19 of supervised professional experience and may require
20 successful completion of an examination.
21     However, any clinical psychologist whose license expired
22 while he or she was (1) in Federal Service on active duty with
23 the Armed Forces of the United States, or the State Militia
24 called into service or training, or (2) in training or
25 education under the supervision of the United States
26 preliminary to induction into the military service, may have

1 his or her license renewed or restored without paying any
2 lapsed renewal fees if within 2 years after honorable
3 termination of such service, training or education he or she
4 furnishes the Department with satisfactory evidence to the
5 effect that he or she has been so engaged and that his or her
6 service, training or education has been so terminated.
