Amends the Animal Welfare Act and the State Finance Act to create the Animal Welfare Fund as a special fund in the State Treasury. Requires all fees and other money received by the Department of Agriculture under the Animal Welfare Act to be deposited into the Fund. Subject to appropriation, requires moneys in the Animal Welfare Fund to be used by the Department for the purpose of enforcing the Animal Welfare Act. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 5.755 as follows:

Sec. 5.755. The Animal Welfare Fund.

Section 10. The Animal Welfare Act is amended by changing Section 22 and by adding Section 23 as follows:

Sec. 22.

All fees and other money received by the Department under this Act shall be paid into the Animal Welfare General Revenue Fund in the State Treasury.

Sec. 23. Animal Welfare Fund. There is hereby created in the State Treasury a special fund to be known as the Animal Welfare Fund. All fees and other money received by the Department under the Animal Welfare Act shall, and gifts, grants, and other moneys from any source may, be deposited into the Fund. All amounts held in the Animal Welfare Fund shall be invested at interest by the State Treasurer. All income attributable to moneys in the Fund shall be deposited into the Fund no less frequently than quarterly. Subject to appropriation, moneys in the Animal Welfare Fund shall be used by the Department of Agriculture for the purpose of enforcing the Animal Welfare Act.

Section 99. Effective date. This Act takes effect upon becoming law.
