SYNOPSIS AS INTRODUCED:
 
215 ILCS 106/26 new
215 ILCS 170/36 new
305 ILCS 5/5-1.3 new

    Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that beginning on the effective date of the amendatory Act, there shall be a 2-year moratorium on the expansion of eligibility under the Children's Health Insurance Program and the Covering ALL KIDS Health Insurance Program. Provides that beginning on the effective date of the amendatory Act, there shall be a 2-year moratorium on the expansion of eligibility or the creation of new programs which would add new categories of eligible individuals under the Medicaid program. Further provides that eligibility under these programs may be expanded only if authorized by a 3/5 vote in both the House and Senate. Effective immediately.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children's Health Insurance Program Act is
5 amended by adding Section 26 as follows:
 
6     (215 ILCS 106/26 new)
7     Sec. 26. Moratorium on eligibility. Beginning on the
8 effective date of this amendatory Act of the 96th General
9 Assembly, there shall be a 2-year moratorium on the expansion
10 of eligibility under the Program. Eligibility may be expanded
11 only if authorized by a 3/5 vote in both the House and Senate.
 
12     Section 10. The Covering ALL KIDS Health Insurance Act is
13 amended by adding Section 36 as follows:
 
14     (215 ILCS 170/36 new)
15     Sec. 36. Moratorium on eligibility. Beginning on the
16 effective date of this amendatory Act of the 96th General
17 Assembly, there shall be a 2-year moratorium on the expansion
18 of eligibility under the Program. Eligibility may be expanded
19 only if authorized by a 3/5 vote in both the House and Senate.
 
20     Section 15. The Illinois Public Aid Code is amended by

1 adding Section 5-1.3 as follows:
 
2     (305 ILCS 5/5-1.3 new)
3     Sec. 5-1.3. Moratorium on eligibility and program
4 expansions. Beginning on the effective date of this amendatory
5 Act of the 96th General Assembly, there shall be a 2-year
6 moratorium on the expansion of eligibility or the creation of
7 new programs which would add new categories of eligible
8 individuals under the medical assistance program under this
9 Article. Eligibility may be expanded only if authorized by a
10 3/5 vote in both the House and Senate.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
