SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/34-18.13   from Ch. 122, par. 34-18.13
30 ILCS 805/8.34 new

    Amends the Chicago School District Article of the School Code. Provides that under the Chicago Board of Education's policies and rules concerning infectious disease, the Board shall require that all students wash their hands with a soap or detergent before consuming any meal at school and shall identify nationally accepted standards from the Centers for Disease Control and Prevention and provide the facilities, materials, and supervision necessary to implement the handwashing requirement. Amends the State Mandates Act to require implementation without reimbursement.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 34-18.13 as follows:
 
6     (105 ILCS 5/34-18.13)  (from Ch. 122, par. 34-18.13)
7     Sec. 34-18.13. Infectious disease policies and rules. The
8 Board of Education shall develop policies and adopt rules
9 relating to the appropriate manner of managing children with
10 chronic infectious diseases, not inconsistent with guidelines
11 published by the State Board of Education and the Illinois
12 Department of Public Health. Such policies and rules must
13 include evaluation of students with a chronic infectious
14 disease on an individual case-by-case basis, and may include
15 different provisions for different age groups, classes of
16 instruction, types of educational institution, and other
17 reasonable classifications, as the Board may find appropriate.
18 Under these policies and rules, the Board shall require that
19 all students wash their hands with a soap or detergent before
20 consuming any meal at school and shall identify nationally
21 accepted standards from the Centers for Disease Control and
22 Prevention and provide the facilities, materials, and
23 supervision necessary to implement the handwashing

3     Section 90. The State Mandates Act is amended by adding
4 Section 8.34 as follows:
 
5     (30 ILCS 805/8.34 new)
6     Sec. 8.34. Exempt mandate. Notwithstanding Sections 6 and 8
7 of this Act, no reimbursement by the State is required for the
8 implementation of any mandate created by this amendatory Act of
9 the 96th General Assembly.
