SYNOPSIS AS INTRODUCED:
 
225 ILCS 57/17 new

    Amends the Massage Licensing Act. Provides that a person who has applied in writing to the Department of Financial and Professional Regulation to engage in massage for compensation and who has fulfilled the licensure requirements of the Act, with the exception of receipt of notification of his or her examination results, may practice under the direct supervision of a massage therapist who is licensed in the State, until specified conditions are met. Specifies (1) the scope of actions that an applicant may perform under a licensed massage therapist and (2) under what conditions an applicant must cease those actions. Effective immediately.

1     AN ACT concerning professional regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Massage Licensing Act is amended by adding
5 Section 17 as follows:
 
6     (225 ILCS 57/17 new)
7     Sec. 17. Practice pending licensure.
8     (a) A person who has applied in writing to the Department
9 to engage in massage for compensation and who has fulfilled the
10 requirements of Section 15 of this Act, with the exception of
11 receipt of notification of his or her examination results, may
12 practice under the direct supervision of a massage therapist
13 who is licensed in this State, until: (1) the applicant has
14 been notified of his or her failure to pass the examination
15 authorized by the Department; (2) the applicant has withdrawn
16 his or her application; (3) the applicant has received a
17 license from the Department after successfully passing the
18 examination authorized by the Department; or (4) the applicant
19 has been notified by the Department to cease and desist from
20 practicing.
21     (b) The applicant shall perform only those acts that may be
22 prescribed by and incidental to his or her employment and those
23 acts shall be performed under the direction of a supervising

1 massage therapist who is licensed in this State. The applicant
2 shall not be entitled to otherwise engage in the practice of
3 massage therapy until fully licensed in this State.
4     (c) The Department shall immediately notify, by certified
5 mail, the supervising massage therapist employing the
6 applicant and the applicant that the applicant shall
7 immediately cease and desist from practicing if the applicant:
8 (1) practices outside his or her employment under a licensed
9 massage therapist; (2) violates any provision of this Act; or
10 (3) becomes ineligible for licensure under this Act.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
