SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-12-5   from Ch. 38, par. 1003-12-5

    Amends the Unified Code of Corrections. Provides that committed persons who are not assigned work in a correctional employment program shall receive no pay or other compensation during the period in which they are not assigned work in a Department institution or facility. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Unified Code of Corrections is amended by
5 changing Section 3-12-5 as follows:
 
6     (730 ILCS 5/3-12-5)  (from Ch. 38, par. 1003-12-5)
7     Sec. 3-12-5. Compensation.
8     (a) Persons performing a work assignment under subsection
9 (a) of Section 3-12-2 may receive wages under rules and
10 regulations of the Department. In determining rates of
11 compensation, the Department shall consider the effort, skill
12 and economic value of the work performed. Compensation may be
13 given to persons who participate in other programs of the
14 Department. Of the compensation earned pursuant to this
15 Section, a portion, as determined by the Department, shall be
16 used to offset the cost of the committed person's
17 incarceration. If the committed person files a lawsuit
18 determined frivolous under Article XXII of the Code of Civil
19 Procedure, 50% of the compensation shall be used to offset the
20 filing fees and costs of the lawsuit as provided in that
21 Article until all fees and costs are paid in full. All other
22 wages shall be deposited in the individual's account under
23 rules and regulations of the Department. The Department shall

1 notify the Attorney General of any compensation applied towards
2 a satisfaction, in whole or in part, of the person's
3 incarceration costs.
4     (b) Committed persons who are not assigned work under
5 subsection (a) of Section 3-12-2 shall receive no pay or other
6 compensation during the period in which they are not assigned
7 work in a Department institution or facility.

9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
