SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-335

    If House Bill 35 of the 96th General Assembly becomes law, amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Requires that the Illinois Transparency and Accountability Portal include databases of specified information concerning (i) State funds, (ii) members of State executive branch boards, commissions, councils, and committees, and (iii) the budgets of those executive branch entities.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. If House Bill 35 of the 96th General Assembly
5 becomes law, the Department of Central Management Services Law
6 of the Civil Administrative Code of Illinois is amended by
7 changing Section 405-335 as follows:
 
8     (20 ILCS 405/405-335)
9     Sec. 405-335. Illinois Transparency and Accountability
10 Portal (ITAP).
11     (a) The Department, within 12 months after the effective
12 date of this amendatory Act of the 96th General Assembly, shall
13 establish and maintain a website, known as the Illinois
14 Transparency and Accountability Portal (ITAP), with a
15 full-time webmaster tasked with compiling and updating the ITAP
16 database with information received from all State agencies as
17 defined in this Section.
18     (b) For purposes of this Section:
19     "State agency" means the offices of the constitutional
20 officers identified in Article V of the Illinois Constitution,
21 executive agencies, and departments, boards, commissions, and
22 Authorities under the Governor, and boards, commissions,
23 councils, and committees of the executive branch of State

1 government.
2     "Contracts" means payment obligations with vendors on file
3 with the Office of the Comptroller to purchase goods and
4 services exceeding $10,000 in value (or, in the case of
5 professional or artistic services, exceeding $5,000 in value).
6     "Appropriation" means line-item detail of spending
7 approved by the General Assembly and Governor, categorized by
8 object of expenditure.
9     "Individual consultants" means temporary workers eligible
10 to receive State benefits paid on a State payroll.
11     "Recipients" means State agencies receiving
12 appropriations.
13     (c) The ITAP shall provide direct access to each of the
14 following:
15         (1) A database of all current State employees, and
16     individual consultants, and members of State executive
17     branch boards, commissions, councils, and committees,
18     except sworn law enforcement officers, sorted separately,
19     as applicable, by:
20                 (i) Name.
21                 (ii) Employing State agency that employs the
22             person or of which the person is a member.
23                 (iii) Employing State division.
24                 (iv) Employment position title.
25                 (v) Current pay rate and year-to-date pay,
26             including per diem, stipend, and expense

1             reimbursement or allowance.
2         (2) A database of all current State expenditures,
3     sorted separately by agency, category, recipient, and
4     Representative District.
5         (3) A database of all development assistance
6     reportable pursuant to the Corporate Accountability for
7     Tax Expenditures Act, sorted separately by tax credit
8     category, taxpayer, and Representative District.
9         (4) A database of all revocations and suspensions of
10     State occupation and use tax certificates of registration
11     and all revocations and suspensions of State professional
12     licenses, sorted separately by name, geographic location,
13     and certificate of registration number or license number,
14     as applicable. Professional license revocations and
15     suspensions shall be posted only if resulting from a
16     failure to pay taxes, license fees, or child support.
17         (5) A database of all current State contracts, sorted
18     separately by contractor name, awarding officer or agency,
19     contract value, and goods or services provided.
20         (6) A database of the separately enumerated budget, for
21     the current fiscal year, of each independent or
22     quasi-independent board, commission, council, or committee
23     of the executive branch of State government, whether or not
24     under the jurisdiction or control of an executive branch
25     constitutional officer, including (i) an enumeration of
26     all moneys expended on behalf of the board, commission,

1     council, or committee by any State agency or department
2     that has been instructed to provide staff support to that
3     board, commission, council, or committee and (ii) an
4     enumeration, by member name, of the pay, if any, and the
5     expenses, including any per diem, stipend, and expense
6     reimbursement or allowance paid to or on behalf of each
7     member of the board, commission, council, or committee.
8         (7) A database of separate enumerations for each
9     special fund within the State treasury, including for each
10     fund (i) double-entry information, including transfers
11     into and transfers from the fund, (ii) transfers from the
12     fund for purposes other than the fund's enumerated purpose,
13     such as fund sweeps, which must be flagged, and (iii) if
14     the fund is invested in an interest-bearing account or
15     otherwise invested, a description of the way the fund is
16     invested and the performance of the investment on a
17     year-to-year basis.
18     (d) The ITAP shall include all information required to be
19 published by subsection (c) of this Section that is available
20 to the Department in a format the Department can compile and
21 publish on the ITAP. The Department shall update the ITAP as
22 additional information becomes available in a format that can
23 be compiled and published on the ITAP by the Department.
24     (e) Each State agency shall cooperate with the Department
25 in furnishing the information necessary for the implementation
26 of this Section within a timeframe specified by the Department.

2     Section 95. No acceleration or delay. Where this Act makes
3 changes in a statute that is represented in this Act by text
4 that is not yet or no longer in effect (for example, a Section
5 represented by multiple versions), the use of that text does
6 not accelerate or delay the taking effect of (i) the changes
7 made by this Act or (ii) provisions derived from any other
8 Public Act.
