1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-323 as follows:
 
7     (20 ILCS 2310/2310-323 new)
8     Sec. 2310-323. Advisory Council on Youth HIV/AIDS
9 Prevention Messages.
10     (a) Subject to appropriation, there is created the Advisory
11 Council on Youth HIV/AIDS Prevention Messages to advise the
12 Department on effective prevention messages designed to
13 educate and deter youth from engaging in risky behaviors that
14 could result in the transmission of HIV/AIDS.
15     (b) The Advisory Council shall consist of all of the
16 following members:
17         (1) One member of the Senate appointed by the President
18     of the Senate and one member of the Senate appointed by the
19     Minority Leader of the Senate.
20         (2) One member of the House of Representatives
21     appointed by the Speaker of the House of Representatives
22     and one member of the House of Representatives appointed by
23     the Minority Leader of the House of Representatives.

1         (3) Five members appointed by the Governor as follows:
2             (A) One representative of a social service agency
3         that provides services to youth and families infected
4         or impacted by HIV/AIDS.
5             (B) One person from academia with a background or
6         expertise in HIV/AIDS prevention messages.
7             (C) One representative of the Department of Human
8         Services.
9             (D) One person with a background in public health.
10             (E) One youth member 18 years old or older and
11         under 24 years.
12         (4) The public information officer of the Department of
13     Public Health, who shall be a non-voting member of the
14     Advisory Council.
15     Each voting member shall serve for a term of 3 years and
16 until his or her successor is appointed and has qualified.
17 Vacancies shall be filled in the same manner as original
18 appointments.
19     (c) The Advisory Council shall meet to organize and select
20 a chairperson upon appointment of a majority of the members.
21 The chairperson shall be elected by a majority vote of the
22 members appointed to the Advisory Council. The Advisory Council
23 shall meet at least 4 times a year at the call of the
24 chairperson. Members of the Advisory Council shall serve
25 without compensation, but may be reimbursed for reasonable
26 expenses incurred as a result of their duties as members of the

1 Advisory Council from funds appropriated by the General
2 Assembly for that purpose.
3     (d) The Advisory Council shall submit an annual report to
4 the Department on or before July 1, 2010 and on or before July
5 1 of each year thereafter with recommendations for effective
6 prevention messages aimed at youth, including recommendations
7 regarding the use of technology to deliver such messages.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
