SYNOPSIS AS INTRODUCED:
 
215 ILCS 106/27 new
215 ILCS 170/37 new
305 ILCS 5/5-1.5 new

    Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that eligibility and benefits under the Children's Health Insurance Program, the Covering ALL KIDS Health Insurance Program, or Medicaid may be expanded only as authorized by law and may not be expanded by any other means, including agency rules or policy changes. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children's Health Insurance Program Act is
5 amended by adding Section 27 as follows:
 
6     (215 ILCS 106/27 new)
7     Sec. 27. Expansion of eligibility or benefits. Eligibility
8 or benefits under the Program may be expanded only as
9 authorized by law and may not be expanded by any other means,
10 including agency rules or policy changes.
 
11     Section 10. The Covering ALL KIDS Health Insurance Act is
12 amended by adding Section 37 as follows:
 
13     (215 ILCS 170/37 new)
14     Sec. 37. Expansion of eligibility or benefits. Eligibility
15 or benefits under the Program may be expanded only as
16 authorized by law and may not be expanded by any other means,
17 including agency rules or policy changes.
 
18     Section 15. The Illinois Public Aid Code is amended by
19 adding Section 5-1.5 as follows:

1     (305 ILCS 5/5-1.5 new)
2     Sec. 5-1.5. Expansion of eligibility or benefits.
3 Eligibility or benefits under the medical assistance program
4 under this Article may be expanded only as authorized by law
5 and may not be expanded by any other means, including agency
6 rules or policy changes.
 
7     Section 99. Effective date. This Act takes effect upon
8 becoming law.
