720 ILCS 5/10-8   from Ch. 38, par. 10-8

    Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the unlawful sale of public conveyance travel tickets to a minor.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 10-8 as follows:
 
6     (720 ILCS 5/10-8)  (from Ch. 38, par. 10-8)
7     Sec. 10-8. Unlawful sale of a public conveyance travel
8 ticket to a minor.
9     (a) A person commits the the offense of unlawful sale of a
10 public conveyance travel ticket to a minor when the person
11 sells a ticket for travel on any public conveyance to an
12 unemancipated minor under 17 years of age without the consent
13 of the minor's parents or guardian for passage to a destination
14 outside this state and knows the minor's age or fails to take
15 reasonable measures to ascertain the minor's age.
16     (b) Evidence. The fact that the defendant demanded, was
17 shown, and reasonably relied upon written evidence of a
18 person's age in any transaction forbidden by this Section is
19 competent evidence, and may be considered in any criminal
20 prosecution for a violation of this Section.
21     (c) Definition. "Public Conveyance", includes an airplane,
22 boat, bus, railroad, train, taxicab or other vehicle used for
23 the transportation of passengers for hire.

1     (d) Sentence. Unlawful sale of a public conveyance travel
2 ticket to a minor is a Class C misdemeanor.
