1     AN ACT concerning caller identification.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Internet Caller Identification Act.
 
6     Section 5. Definition. As used in this Act:
7     "Caller identification" means the display of the caller's
8 telephone number or identity to the recipient of the call.
 
9     Section 10. Internet caller identification. No person,
10 other than the recipient of the call, shall use any Internet
11 caller identification equipment or Internet phone equipment in
12 such a manner as to make a number or name, other than the
13 residential or business phone number or legal or business name
14 of the subscriber or registered user of the Internet phone
15 service, appear on a caller identification system of the
16 recipient of the call. This Section does not apply to service
17 providers who transmit caller identification information
18 created or supplied by others.
 
19     Section 15. Violations. Whenever any person knowingly uses
20 or has knowingly used any Internet caller identification
21 equipment or Internet phone equipment in violation of this Act,

1 that use shall be deemed an unlawful act or practice under the
2 Consumer Fraud and Deceptive Business Practices Act. In the
3 case of the use of Internet caller identification or Internet
4 phone equipment in violation of this Act, all remedies,
5 penalties, and authority available to the Attorney General and
6 the several State's Attorneys under the Consumer Fraud and
7 Deceptive Business Practices Act for the enforcement of that
8 Act shall be available for the enforcement of this Act.
 
9     Section 85. The Consumer Fraud and Deceptive Business
10 Practices Act is amended by changing Section 2Z as follows:
 
11     (815 ILCS 505/2Z)  (from Ch. 121 1/2, par. 262Z)
12     Sec. 2Z. Violations of other Acts. Any person who knowingly
13 violates the Automotive Repair Act, the Automotive Collision
14 Repair Act, the Home Repair and Remodeling Act, the Dance
15 Studio Act, the Physical Fitness Services Act, the Hearing
16 Instrument Consumer Protection Act, the Illinois Union Label
17 Act, the Job Referral and Job Listing Services Consumer
18 Protection Act, the Travel Promotion Consumer Protection Act,
19 the Credit Services Organizations Act, the Automatic Telephone
20 Dialers Act, the Pay-Per-Call Services Consumer Protection
21 Act, the Telephone Solicitations Act, the Illinois Funeral or
22 Burial Funds Act, the Cemetery Care Act, the Safe and Hygienic
23 Bed Act, the Pre-Need Cemetery Sales Act, the High Risk Home
24 Loan Act, the Payday Loan Reform Act, the Mortgage Rescue Fraud

1 Act, subsection (a) or (b) of Section 3-10 of the Cigarette Tax
2 Act, the Payday Loan Reform Act, subsection (a) or (b) of
3 Section 3-10 of the Cigarette Use Tax Act, the Electronic Mail
4 Act, the Internet Caller Identification Act, paragraph (6) of
5 subsection (k) of Section 6-305 of the Illinois Vehicle Code,
6 Article 3 of the Residential Real Property Disclosure Act, the
7 Automatic Contract Renewal Act, or the Personal Information
8 Protection Act commits an unlawful practice within the meaning
9 of this Act.
