    Amends the Professional Boxing Act. Includes a person licensed to treat human ailments without the use of drugs and without operative surgery under the Medical Practice Act of 1987 in the definition of "physician". Contains a nonacceleration clause. Effective June 1, 2008.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Professional Boxing Act is amended by
5 changing Sections 1 and 12 as follows:

9     Sec. 1. Short title and definitions.
10     (a) This Act may be cited as the Professional Boxing Act.
11     (b) As used in this Act:
12         1. "Department" means the Department of Professional
13     Regulation.
14         2. "Director" means the Director of Professional
15     Regulation.
16         3. "Board" means the State Professional Boxing Board
17     appointed by the Director.
18         4. "License" means the license issued for boxing
19     promoters, contestants, or officials in accordance with
20     this Act.
21         5. (Blank).
22         6. "Boxing Contests" include professional boxing
23     matches and exhibitions.

3         9. "Permit" means the authorization from the
4     Department to a promoter to conduct professional boxing
5     contests.
6         10. "Promoter" means a person who is licensed and who
7     holds a permit to conduct professional boxing contests.
8         11. Unless the context indicates otherwise, "person"
9     includes an association, partnership, corporation,
10     gymnasium, or club.
11         12. (Blank).
12         13. "Ultimate fighting exhibition" has the meaning
13     given by rule adopted by the Department in accordance with
14     Section 7.5.
15         14. "Professional boxer" means a person licensed by the
16     Department who competes for a money prize, purse, or other
17     type of compensation in a boxing contest, exhibition, or
18     match held in Illinois.
19         15. "Judge" means a person licensed by the Department
20     who is at ringside during a boxing match and who has the
21     responsibility of scoring the performance of the
22     participants in the contest.
23         16. "Referee" means a person licensed by the Department
24     who has the general supervision of a boxing contest and is
25     present inside of the ring during the contest.
26         17. "Amateur" means a person who has never received or

1     competed for any purse or other article of value, either
2     for participating in any boxing contest or for the expenses
3     of training therefor, other than a prize that does not
4     exceed $50 in value.
5         18. "Contestant" means an individual who participates
6     in a boxing contest.
7         19. "Second" means a person licensed by the Department
8     who is present at any boxing contest to provide assistance
9     or advice to a boxer during the contest.
10         20. "Matchmaker" means a person licensed by the
11     Department who brings together professional boxers or
12     procures matches or contests for professional boxers.
13         21. "Manager" means a person licensed by the Department
14     who is not a promoter and who, under contract, agreement,
15     or other arrangement with any boxer, undertakes to,
16     directly or indirectly, control or administer the boxing
17     affairs of boxers.
18         22. "Timekeeper" means a person licensed by the
19     Department who is the official timer of the length of
20     rounds and the intervals between the rounds.
21         23. "Purse" means the financial guarantee or any other
22     remuneration for which contestants are participating in a
23     boxing contest.
24         24. "Physician" means a person licensed to practice
25     medicine in all its branches under the Medical Practice Act
26     of 1987.

10     remuneration for which contestants are participating in a
11     contest.
12         24. "Physician" means a person licensed to practice
13     medicine in all its branches or a person licensed to treat
14     human ailments without the use of drugs and without
15     operative surgery under the Medical Practice Act of 1987.
16         25. "Martial arts" means a discipline such as, but not
17     limited to, Karate, Kung Fu, Jujitsu, Muay Thai, Tae Kwon
18     Do, and Kick-boxing.
19         26. "Mixed martial arts" means the use of a combination
20     of techniques from different disciplines of the martial
21     arts, including without limitation grappling, kicking, and
22     striking.

2     Sec. 12. Contests. Each boxing contestant shall be examined
3 before entering the ring and immediately after each contest by
4 a physician licensed to practice medicine in all of its
5 branches. The physician shall determine, prior to the contest,
6 if each contestant is physically fit to engage in the contest.
7 After the contest the physician shall examine the contestant to
8 determine possible injury. If the contestant's physical
9 condition so indicates, the physician shall recommend to the
10 Department immediate medical suspension. The physician may, at
11 any time during the contest, stop the contest to examine a
12 boxer, and terminate the contest when, in the physician's
13 opinion, continuing the contest could result in serious injury
14 to the boxer. The physician shall certify to the condition of
15 the contestant in writing, over his signature on blank forms
16 provided by the Department. Such reports shall be submitted to
17 the Department in a timely manner. The physician shall be paid
18 by the promoter a fee fixed by the Department. No boxing
19 contest shall be held unless a physician licensed to practice
20 medicine in all of its branches is in attendance.
21     No contest shall be allowed to begin unless at least one
22 physician and 2 trained paramedics or 2 nurses who are trained
23 to administer emergency medical care are present.
24     No contest shall be more than 12 rounds in length. The
25 rounds shall not be more than 3 minutes each with a one minute
26 interval between them, and no boxer shall be allowed to

1 participate in more than 12 rounds within 72 consecutive hours.
2 At each boxing contest there shall be a referee in attendance
3 who shall direct and control the contest. The referee, before
4 each contest, shall learn the name of the contestant's chief
5 second and shall hold the chief second responsible for the
6 conduct of his assistant during the progress of the contest.
7     There shall be 2 judges in attendance who shall render a
8 decision at the end of each contest. The decision of the
9 judges, taken together with the decision of the referee, is
10 final; or, 3 judges shall score the contest with the referee
11 not scoring. The method of scoring shall be set forth in rules.
12     Judges, referees, or timekeepers for contests shall be
13 assigned by the Department. The Department or its
14 representative shall have discretion to declare a price,
15 remuneration, or purse or any part of it belonging to the
16 contestant withheld if in the judgment of the Department or its
17 representative the contestant is not honestly competing. The
18 Department shall have the authority to prevent a contest or
19 exhibition from being held and shall have the authority to stop
20 a fight for noncompliance with any part of this Act or rules or
21 when, in the judgment of the Department, or its representative,
22 continuation of the event would endanger the health, safety,
23 and welfare of the contestants or spectators. The Department's
24 authority to stop a fight contest or exhibition on the basis
25 that the fight would endanger the health, safety, and welfare
26 of the contestants or spectators shall extend to any fight

1 contest or exhibition, regardless of whether that fight contest
2 or exhibition is exempted from the prohibition in Section 6 of
3 this Act.

4 dedicated solely for the care of contestants are present.
5     No boxing contest shall be more than 12 rounds in length.
6 The rounds shall not be more than 3 minutes each with a one
7 minute interval between them, and no boxing contestant boxer
8 shall be allowed to participate in more than 12 rounds within
9 72 consecutive hours. The number and length for all other
10 contests shall be established by rule. At each contest there
11 shall be a referee in attendance who shall direct and control
12 the contest. The referee, before each contest, shall learn the
13 name of the contestant's chief second and shall hold the chief
14 second responsible for the conduct of his assistant during the
15 progress of the contest.
16     There shall be 2 judges in attendance at all boxing
17 contests who shall render a decision at the end of each
18 contest. The decision of the judges, taken together with the
19 decision of the referee, is final; or, 3 judges shall score the
20 contest with the referee not scoring. The method of scoring
21 shall be set forth in rules. The number of judges required and

23 rule.

16     Section 95. No acceleration or delay. Where this Act makes
17 changes in a statute that is represented in this Act by text
18 that is not yet or no longer in effect (for example, a Section
19 represented by multiple versions), the use of that text does
20 not accelerate or delay the taking effect of (i) the changes
21 made by this Act or (ii) provisions derived from any other
22 Public Act.
 
23     Section 99. Effective date. This Act takes effect upon
24 becoming law.
