1     AN ACT concerning State government.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Children and Family Services Act is amended
5 by adding Section 5.35 as follows:

6     (20 ILCS 505/5.35 new)
7     Sec. 5.35. Residential services; rates.
8     (a) In this Section, "residential services" include
9 residential treatment, group home care, independent living,
10 and transitional living services.
11     (b) Subject to appropriation, the Department shall work
12 with representatives of voluntary residential services
13 providers to develop a performance-based contract model that
14 fully funds the cost of care provided by residential services
15 providers beginning in State fiscal year 2010. On and after
16 July 1, 2008, the Department shall work with other State
17 agencies that require residential services for children in
18 their care, including but not limited to the Department of
19 Human Services, the Department of Juvenile Justice, and the
20 Illinois State Board of Education, to develop program
21 requirements and rates that are not less than the
22 performance-based rates set by the Department of Children and
23 Family Services.

1     Section 99. Effective date. This Act takes effect July 1,
2 2008.
