1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Commission to Study Disproportionate Justice Impact Act.
 
6     Section 5. Purpose. There is created a Commission to Study
7 Disproportionate Justice Impact. The Commission shall:
8         (1) study the nature and extent of the harm caused to
9     minority communities through the practical application of
10     the violation and sentencing provisions of the Illinois
11     Vehicle Code, the Criminal Code of 1961, the Cannabis
12     Control Act, the Illinois Controlled Substances Act, the
13     Methamphetamine Control and Community Protection Act, and
14     the Unified Code of Corrections;
15         (2) develop specific findings on the nature and extent
16     of the harm caused to minority communities; and
17         (3) offer recommendations for legislation and policy
18     changes to address the disproportionate impact that even
19     facially neutral laws can have on minority communities.
 
20     Section 10. Composition. The Commission shall be composed
21 of the following members:
22         (a) Two members of the Senate appointed by the Senate

1     President, one of whom the President shall designate to
2     serve as co-chair, and two members of the Senate appointed
3     by the Minority Leader of the Senate.
4         (b) Two members of the House of Representatives
5     appointed by the Speaker of the House of Representatives,
6     one of whom the Speaker shall designate to serve as
7     co-chair, and two members of the House of Representatives
8     appointed by the Minority Leader of the House of
9     Representatives.
10         (c) The following persons or their designees:
11             (1) the Attorney General,
12             (2) the Chief Judge of the Circuit Court of Cook
13         County,
14             (3) the Director of State Police,
15             (4) the Superintendent of the Chicago Police
16         Department,
17             (5) the sheriff of Cook County,
18             (6) the State Appellate Defender,
19             (7) the Cook County Public Defender,
20             (8) the Director of the Office of the State's
21         Attorneys Appellate Prosecutor,
22             (9) the Cook County State's Attorney,
23             (10) the Executive Director of the Criminal
24         Justice Information Authority,
25             (11) the Director of Corrections,
26             (12) the Director of Juvenile Justice, and

1             (13) the Executive Director of the Illinois
2         African-American Family Commission.
3         (d) The co-chairs may name up to 8 persons,
4     representing minority communities within Illinois, groups
5     involved in the improvement of the administration of
6     justice, behavioral health, criminal justice, law
7     enforcement, and the rehabilitation of former inmates,
8     community groups, and other interested parties.
 
9     Section 15. Compensation; support. The members of the
10 Commission shall serve without compensation, but may be
11 reimbursed for reasonable expenses incurred as a result of
12 their duties as members of the Commission from funds
13 appropriated by the General Assembly for that purpose. The
14 Center for Excellence in Criminal Justice at the Great Lakes
15 Addiction Technology Transfer Center at Jane Addams College of
16 Social Work at the University of Illinois at Chicago shall
17 provide staff and administrative support services to the
18 Commission.
 
19     Section 20. Meetings; report. The Commission shall hold
20 one or more public hearings, at which public testimony shall be
21 heard. The Commission shall report its findings and
22 recommendations to the General Assembly on or before December
23 31, 2009, after which the Commission shall dissolve.
