SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/5-40
10 ILCS 5/9-27.5

    Amends the State Officials and Employees Ethics Act. Prohibits State executive branch constitutional officers, General Assembly members, candidates for those offices, General Assembly political caucuses, and political committees of any of the foregoing from holding fundraising functions in Sangamon County or Cook County (now, Sangamon County) during certain periods of the legislative session. amends the Election Code to make conforming changes.

1     AN ACT concerning elections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Officials and Employees Ethics Act is
5 amended by changing Section 5-40 as follows:
 
6     (5 ILCS 430/5-40)
7     Sec. 5-40. Fundraising in Sangamon County or Cook County.
8 Except as provided in this Section, any executive branch
9 constitutional officer, any candidate for an executive branch
10 constitutional office, any member of the General Assembly, any
11 candidate for the General Assembly, any political caucus of the
12 General Assembly, or any political committee on behalf of any
13 of the foregoing may not hold a fundraising function in
14 Sangamon County or Cook County on any day the legislature is in
15 session (i) during the period beginning February 1 and ending
16 on the later of the actual adjournment dates of either house of
17 the spring session and (ii) during fall veto session. For
18 purposes of this Section, the legislature is not considered to
19 be in session on a day that is solely a perfunctory session day
20 or on a day when only a committee is meeting.
21     During the period beginning June 1 and ending on the first
22 day of fall veto session each year, this Section does not apply
23 to (i) a member of the General Assembly whose legislative or

1 representative district is entirely within (A) Sangamon County
2 (with respect to the prohibition against fundraising functions
3 in Sangamon County) or (B) Cook County (with respect to the
4 prohibition against fundraising functions in Cook County) or
5 (ii) a candidate for the General Assembly from that legislative
6 or representative district.

8     Section 10. The Election Code is amended by changing
9 Section 9-27.5 as follows:
 
10     (10 ILCS 5/9-27.5)
11     Sec. 9-27.5. Fundraising in Sangamon County or Cook County.
12 In addition to any other provision of this Code, fundraising
13 events in Sangamon County or Cook County by certain executive
14 branch officers and candidates, legislative branch members and
15 candidates, political caucuses, and political committees are
16 subject to the State Officials and Employees Ethics Act. If a
17 political committee receives and retains a contribution that is
18 in violation of Section 5-40 of the State Officials and
19 Employees Ethics Act, then the State Board may impose a civil
20 penalty upon that political committee in an amount equal to
21 100% of that contribution.
