SYNOPSIS AS INTRODUCED:
 
70 ILCS 1205/4-1   from Ch. 105, par. 4-1

    Amends the Park District Code. Provides that, if there is no vacancy on a governing board consisting of 5 members, 4 members of the governing board constitutes a quorum (instead of a majority of the members). Provides that no vacancy shall impair the right of the remaining board members to exercise all of the powers of the governing board. Provides that every finding, order, or decision approved by a majority of the members of the governing board shall be deemed to be the finding, order, or decision of the governing board.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Park District Code is amended by changing
5 Section 4-1 as follows:
 
6     (70 ILCS 1205/4-1)  (from Ch. 105, par. 4-1)
7     Sec. 4-1. Each member of the governing board of any park
8 district before entering upon the duties of his office shall
9 take and subscribe an oath to well and faithfully discharge his
10 duties, which oath shall be filed with the secretary of said
11 board. The members of such governing board shall constitute the
12 corporate authority for such district and, if there is no
13 vacancy on a governing board consisting of 5 members, 4 members
14 of the governing board a majority of such members shall
15 constitute a quorum for said board at any meeting thereof;
16 otherwise, a majority of the governing board shall constitute a
17 quorum. No vacancy shall impair the right of the remaining
18 board members to exercise all of the powers of the governing
19 board. Every finding, order, or decision approved by a majority
20 of the members of the governing board shall be deemed to be the
21 finding, order, or decision of the governing board. The members
22 of such governing boards shall act as such without
23 compensation, and each member of the board shall be a legal

1 voter of and reside within such district.
