SYNOPSIS AS INTRODUCED:

    Amends the Copper Purchase Registration Law. Defines "railroad track material". Requires a copper dealer or junk dealer, who purchases railroad track material consisting of 50 pounds or more to enter the listed information on the form provided by the Department of State Police.

1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Copper Purchase Registration Law is amended
5 by changing Sections 2 and 3 as follows:
 
6     (815 ILCS 325/2)  (from Ch. 121 1/2, par. 322)
7     Sec. 2. When used in this Act:
8     "Copper" means any copper, copper alloy or brass bars,
9 cable, ingots, rods, tubing, wire, wire scraps, clamps,
10 connectors, or other appurtenances utilized or that can be
11 utilized by common carriers or by persons, firms, corporations,
12 or municipal corporations engaged in either the generation,
13 transmission or distribution of electric energy or in
14 telephone, telegraph or other communications. ;
15     "Copper dealer" or "junk dealer" means any individual,
16 firm, corporation, or partnership engaged in the business of
17 purchasing and reselling copper or railroad track material
18 either at a permanently established place of business or in
19 connection with a business of an itinerant nature, including
20 junk shops, junk yards, junk stores, auto wreckers, scrap metal
21 dealers or processors, salvage yards, collectors of or dealers
22 in junk and junk carts or trucks.
23     "Railroad track material" means any rails, switch

1 components, spikes, angle bars, tie plates, or bolts of the
2 type utilized by rail carriers.

5     Sec. 3. Except as provided in Section 5 of this Act, every
6 copper dealer or junk dealer in this State shall enter on forms
7 provided by the Department of State Police or such department
8 as may succeed to its functions, for each purchase of copper or
9 railroad track material consisting of 50 pounds or more the
10 following information:
11         1. The name and address of the copper dealer or junk
12     dealer;
13         2. The date and place of each purchase;
14         3. The name and address of the person or persons from
15     whom the copper or railroad track material was purchased;
16         4. The motor vehicle license number of the vehicle or
17     conveyance on which the copper or railroad track material
18     was delivered to the copper dealer or junk dealer;
19         5. A description of the copper purchased, including the
20     weight and whether it consists of bars, cable, ingots,
21     rods, tubing, wire, wire scraps, clamps, connectors or
22     other appurtenances or some combination thereof; or
23     railroad track material purchased, including rails, switch
24     components, spikes, angle bars, tie plates, or bolts of the
25     type utilized by rail carriers.

1     A copy of the completed form shall be kept in a separate
2 book or register by the copper dealer or junk dealer and shall
3 be retained for a period of 2 years. Such book or register
4 shall be made available for inspection by any law enforcement
5 official or the representatives of rail carriers, common
6 carriers and persons, firms, corporations, or municipal
7 corporations engaged in either the generation, transmission,
8 or distribution of electric energy or engaged in telephone,
9 telegraph or other communications, at any time.
