415 ILCS 5/22.3   from Ch. 111 1/2, par. 1022.3

    Amends the Environmental Protection Act. Makes a technical change in a Section concerning hazardous waste disposal sites.

A BILL FOR

 

SB1289 LRB095 05076 CMK 25145 b

1     AN ACT concerning closure and post closure care of a
2 Municipal Solid Waste Landfill site.
 
3     Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
 
5     Section 5. The Environmental Protection Act is amended by
6 changing Section 22.3 as follows:
 
7     (415 ILCS 5/22.3)  (from Ch. 111 1/2, par. 1022.3)
8     Sec. 22.3. The The owner and operator of a hazardous waste
9 disposal site shall, without limitation, be responsible for the
10 site for a period of 20 years after closure of the site, or
11 such longer period of time as required by the federal Resource
12 Conservation and Recovery Act of 1976, P.L. 94-580, or
13 regulations issued thereunder, or by Board regulation adopted
14 pursuant to subsection 22(a) or (f) of this Act. The owner and
15 operator shall monitor such site for gas migration, drainage
16 problems, erosion, settling, ground and surface water
17 pollution and other environmental and safety problems which
18 occur, and shall take whatever remedial action is necessary to
19 solve any such problems which occur at the site during the
20 period of responsibility. Notwithstanding the provisions of
21 this Section, nothing contained herein shall be construed to
22 limit any duties or liabilities imposed on an owner or operator
23 of a solid waste disposal site pursuant to this Act or
