SYNOPSIS AS INTRODUCED:

    Amends the Firearm Owners Identification Card Act. Changes the number of petition signatures necessary to place on the ballot the question as to whether the State of Illinois should repeal the Act from 2% to 8%. Changes the ballot proposition from should the General Assembly repeal the Act to should the State of Illinois repeal the Act. Deletes a provision that the petition shall be composed of county petitions from each of the counties throughout the State and each county petition shall contain the signatures of at least 2% of the number of registered voters in the county.

A BILL FOR

1     AN ACT concerning firearms.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Firearm Owners Identification Card Act is
5 amended by changing Sections 16 and 16.1 as follows:
 
6     (430 ILCS 65/16)  (from Ch. 38, par. 83-16)
7     Sec. 16. When 8% 2% of the number of registered voters in
8 the State desire to pass upon the question of whether the State
9 of Illinois General Assembly should repeal this Act regulating
10 the acquisition, possession and transfer of firearms and
11 firearm ammunition, they shall, at least 78 days before a
12 regular election to be held throughout the State, file in the
13 office of the State Board of Elections, a petition directed to
14 the Board in accordance with the general election law. The
15 petition shall be composed of county petitions from each of the
16 counties throughout the State and each county petition shall
17 contain the signatures of at least 2% of the number of
18 registered voters in the county. The petition shall request
19 that the question "Should the State of Illinois General
20 Assembly repeal the Act entitled 'An Act relating to the
21 acquisition, possession and transfer of firearms and firearm
22 ammunition, to provide a penalty for the violation thereof and
23 to make an appropriation in connection therewith,' approved

1 August 3, 1967, as amended?" be submitted to the voters of the
2 State at the next ensuing State-wide election at which such
3 question may be acted upon.

6     Sec. 16.1. A petition for the submission of the proposition
7 shall be in substantially the following form:
8     To the State Board of Elections
9     The undersigned, residents and registered voters of the
10 State of Illinois, respectfully petition that you cause to be
11 submitted, in the manner provided by the general election law
12 to the voters of the State of Illinois, at the next State-wide
13 election, the proposition "Should the State of Illinois General
14 Assembly repeal an Act entitled 'An Act relating to the
15 acquisition, possession and transfer of firearms and firearm
16 ammunition, to provide a penalty for the violation thereof and
17 to make an appropriation in connection therewith', approved
18 August 3, 1967, as amended?"

21     Such petition shall conform to the requirements of the
22 general election law. The Board shall certify the question to
23 the proper election officials who shall submit the question at
24 an election in accordance with the general election law. Upon
25 request of any citizen for a reproduced copy of the petition

1 and paying or tendering to the State Board of Elections the
2 costs of making the copy, the Board shall immediately make, or
3 cause to be made a reproduced copy of such petition. The Board
4 shall also deliver to such person his official certification
5 that such copy is a true copy of the original, stating the day
6 when such original was filed in its office.
