SYNOPSIS AS INTRODUCED:
 
ILCON Art. V, Sec. 1
ILCON Art. V, Sec. 3
ILCON Art. V, Sec. 7
ILCON Art. V, Sec. 17
ILCON Art. V, Sec. 18

    Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Offices of the Comptroller and Treasurer. Provides instead for a single State Fiscal Officer. Provides that the State Fiscal Officer shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. Effective upon being declared adopted, with the first State Fiscal Officer elected in 2010. No Comptroller or Treasurer shall be elected after 2006.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Article V of the
9 Illinois Constitution by changing Sections 1, 3, 7, and 18 and
10 by repealing Section 17 as follows:

THE EXECUTIVE

13     (ILCON Art. V, Sec. 1)
14 SECTION 1. OFFICERS
15     The Executive Branch shall include a Governor, Lieutenant
16 Governor, Attorney General, Secretary of State, and State
17 Fiscal Officer Comptroller and Treasurer elected by the
18 electors of the State. They shall keep the public records and
19 maintain a residence at the seat of government during their
20 terms of office.

1 SECTION 3. ELIGIBILITY
2     To be eligible to hold the office of Governor, Lieutenant
3 Governor, Attorney General, Secretary of State, or State Fiscal
4 Officer Comptroller or Treasurer, a person must be a United
5 States citizen, at least 25 years old, and a resident of this
6 State for the three years preceding his or her election.

9 SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
10     If the Attorney General, Secretary of State, or State
11 Fiscal Officer Comptroller or Treasurer fails to qualify or if
12 the his office becomes vacant, the Governor shall fill the
13 office by appointment. The appointee shall hold office until
14 the elected officer qualifies or until a successor is elected
15 and qualified as may be provided by law and shall not be
16 subject to removal by the Governor. If the Lieutenant Governor
17 fails to qualify or if the his office becomes vacant, it shall
18 remain vacant until the end of the term.

21 SECTION 17. COMPTROLLER - DUTIES (REPEALED)
22     The Comptroller, in accordance with law, shall maintain the
23 State's central fiscal accounts, and order payments into and
24 out of the funds held by the Treasurer.

3 SECTION 18. STATE FISCAL OFFICER TREASURER - DUTIES
4     The State Fiscal Officer Treasurer, in accordance with law,
5 shall (i) maintain the State's central fiscal accounts, and
6 order payments into and out of the funds held by him or her,
7 (ii) be responsible for the safekeeping and investment of
8 monies and securities deposited with him or her, and for their
9 disbursement upon his or her order, and (iii) have the duties
10 and powers that may be prescribed by law of the Comptroller.

SCHEDULE
13     This Constitutional Amendment takes effect upon being
14 declared adopted in accordance with Section 7 of the Illinois
15 Constitutional Amendment Act. A State Fiscal Officer, but not a
16 Comptroller or Treasurer, shall be elected in 2010 and
17 thereafter. This Constitutional Amendment otherwise applies
18 upon the conclusion of the terms of the Comptroller and the
19 Treasurer elected in 2006.
