SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Requires that appropriations must be approved by a three-fifths vote of the members elected to each house of the General Assembly. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Article VIII of the
9 Illinois Constitution by changing Section 2 as follows:

13 SECTION 2. STATE FINANCE
14     (a) The Governor shall prepare and submit to the General
15 Assembly, at a time prescribed by law, a State budget for the
16 ensuing fiscal year. The budget shall set forth the estimated
17 balance of funds available for appropriation at the beginning
18 of the fiscal year, the estimated receipts, and a plan for
19 expenditures and obligations during the fiscal year of every
20 department, authority, public corporation and quasi-public
21 corporation of the State, every State college and university,
22 and every other public agency created by the State, but not of
23 units of local government or school districts. The budget shall

1 also set forth the indebtedness and contingent liabilities of
2 the State and such other information as may be required by law.
3 Proposed expenditures shall not exceed funds estimated to be
4 available for the fiscal year as shown in the budget.
5     (b) The General Assembly by law shall make appropriations
6 for all expenditures of public funds by the State.
7 Appropriations may become law only with the concurrence of
8 three-fifths of the members elected to each house of the
9 General Assembly. Appropriations for a fiscal year shall not
10 exceed funds estimated by the General Assembly to be available
11 during that year.

SCHEDULE
14     This Constitutional Amendment takes effect upon being
15 declared adopted in accordance with Section 7 of the Illinois
16 Constitutional Amendment Act.
