AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2ZZ as follows:

(815 ILCS 505/2ZZ new)

Sec. 2ZZ. Insurance companies; health care facilities; social security numbers.

(a) Except as may be required by federal regulations, an insurance company shall not use a patient's social security number as the patient's identification number or in any mailings sent to the patient.

(b) Except as may be required by federal regulation, a health care facility shall not use a patient's social security number as the patient's identification number or in any mailings sent to the patient.

(c) A violation of this Section constitutes an unlawful practice within the meaning of this Act.

(d) For purposes of this Section:

"Insurance company" means a "company" as defined in Section 2 of the Illinois Insurance Code.

"Health care facility" means any hospital or long term care facility licensed in Illinois.
