Amends the Human Skeletal Remains Protection Act to authorize the Historic Preservation Agency and Illinois State Museum to release human skeletal remains and artifacts to a unit of local government for reburial under specified conditions. Requires the unit of local government to pay for transportation and reinterment.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Human Skeletal Remains Protection Act is amended by changing Section 14 as follows:

Sec. 14. All human skeletal remains and grave artifacts in unregistered graves are held in trust for the people of Illinois by the State and are under the jurisdiction of the Historic Preservation Agency. All materials collected under this Act shall be maintained, with dignity and respect, for the people of the State under the care of the Illinois State Museum.

Nothing in this Act shall prevent the Agency or the Museum from releasing remains when petitioned to do so by a unit of local government requesting reinterment in a cemetery located within the unit of local government's boundaries of the remains after the Agency or Museum has determined the remains are non-indigenous to the place of discovery and of no intrinsic value to warrant further study or archival preservation by either the Agency or the Museum using the methods and technology available at the date of the requested release. All expenses to provide transportation and reinterment at the site of final disposition shall be borne by the petitioning unit of local government and not the Agency, Museum, or the State of Illinois. Release is for burial only, with the remains being placed for interment in a recoverable container, and jurisdiction of the human remains continues to reside with the Agency or the Museum after reinterment. Disinterment of the remains once interred in a cemetery is governed by Illinois law and requires the consent of the Agency or the Museum, as applicable.
