SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/3.4 new

    Amends the Firearm Owners Identification Card Act. Provides that a federally licensed firearm dealer shall have a criminal background check performed on each employee who handles firearms in the course of his or her employment which shall include a fingerprint based criminal background check with a review of fingerprints by the Illinois State Police and Federal Bureau of Investigation. Provides that the Department of State Police shall charge a fee for conducting the criminal history records check, which shall be deposited in the State Police Services Fund and shall not exceed the actual cost of the records check. Provides that until the criminal background check is completed, the employee may not handle firearms during the course of his or her employment.

1     AN ACT concerning firearms.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Firearm Owners Identification Card Act is
5 amended by adding Section 3.4 as follows:
 
6     (430 ILCS 65/3.4 new)
7     Sec. 3.4. Federally licensed dealers of firearms; employee
8 criminal background check. A federally licensed firearm dealer
9 shall have a criminal background check performed on each
10 employee who handles firearms in the course of his or her
11 employment which shall include a fingerprint based criminal
12 background check with a review of fingerprints by the Illinois
13 State Police and Federal Bureau of Investigation. Each employee
14 of the federally licensed firearm dealer shall submit his or
15 her fingerprints to the Department of State Police in the form
16 and manner prescribed by the Department of State Police. These
17 fingerprints shall be checked against the fingerprint records
18 now and hereafter filed in the Department of State Police and
19 Federal Bureau of Investigation criminal history records
20 databases. The Department of State Police shall charge a fee
21 for conducting the criminal history records check, which shall
22 be deposited in the State Police Services Fund and shall not
23 exceed the actual cost of the records check. The criminal

1 background check required by this Section shall include a
2 listing of when, where, and by whom the criminal background
3 check was prepared. The criminal background check required by
4 this Section shall not be more than 2 years old. Until the
5 criminal background check is completed, the employee may not
6 handle firearms during the course of his or her employment.
